Advice please on faulty Samsung Galaxy S2

Bought a SGS2 last year on contract, since upgrading to Android ICS ...

    Exclamation Advice please on faulty Samsung Galaxy S2

    Bought a SGS2 last year on contract, since upgrading to Android ICS via official Kies software have been having issues with the wifi hanging and not starting, as a result phone locks up if the screen times out, forced restart required and sometimes the battery loses about 40% of it's charge because of the problem. Main issue is wifi intermittently not working, only way to fix is restarting the phone, starting to p**s me off now. What are my rights as a consumer with regards to the sales of goods act in UK? Just a bit confused as it's monthly payments & also still have 11 months left, what amount am I entitled to a refund for? The full cost of the contract? Btw been through the Samsung route, even sent the handset off for a repair, but problems still persist! Asked them for a refund or exchange, they told me to speak to the retailer (Carphone Warehouse). Called retailer & they've said all they can do is send it off to Samsung for a repair which I have already done. I know I can claim back a refund but off who? The credit card company or Samsung? As Samsung provided the official firmware which resulted in the phone becoming faulty CPW don't have anything to do with this. Just need some clarification. Thankyou in advance.

    You first call should be where you otained it from. If they try and pass the buck. Inform them you will will take them to a small claims court, also inform the credit card company you are in dispute, because it is not merchantable quality.

    You could not have asked for a better advice when shady, nara, macca58, johnner they will keep you reminding you in every thread of shites that’s what they are hear and you better get used to it!!!!!!!!!!!

    Ok but the problem has been caused by Samsung as a result of a firmware they have provided for consumers to upgrade to. There was nothing wrong with the handset before the firmware was upgraded. I have called Carphone Warehouse who have said all they can do is send it off to Samsung again. Just been on the phone AGAIN to Samsung who want me to send the handset off AGAIN for repair.

    Yes true not many retailers want anything to do with you once money has changed hands however I believe I should be able to get an exchange from Carphone Warehouse. Anyone willing to lend me a shotgun?

    Ok, as the phone is a free gift as part of the mobile contract you cannot do a lot. The contract you purchase is for airtime. Minutes and texts, the phone is actually a free gift as part of the deal.

    So don't bother taking them to a small claims court as you will lose! I would suggest sending the phone off again, or updating the FW yourself. Change it to ice cream sandwich or similar and see if that makes any difference.

    Whilst I sympathies with your situation you will not get a refund on the contract. Only way you can get out of a mobile contract is if there is no signal where you live, as stated you are paying for airtime and not the phone.

    As janobi has stated, you have no chance of a refund. Whoever put the idea of a refund in your head needs shooting.

    The network is only responsible for allowing access to their services. That puts their responsibility on the SIM card. So unless you have taken out insurance with them that's as far as that goes.

    Carphone Whorehouse will only cover warranty, unless you took out insurance with them. They will just keep sending it back to samsung. The only good news is that the warranty covers the term of the contract, usually 2 years.

    I'll put my money on a bad installation of the firmware. If kies won't let you reinstall, speak to samsung about flashing with Odin. Make sure they will still honor the warranty if you flash using Odin. It's far more reliable than using kies.

    Always ensure you perform a factory reset after installing any firmware.

    The phones is NOT a free gift, it forms part of the contract!

    Try to cancel your contract early and you'll find that they will claw back the cost (or part thereof) of the handset!

    We all know though that of course the phone is not free, they claim it's free however cover the cost of it is included in the bloated price for the mins txts & data. Ok where do I stand with getting an exchange? I'm being told I can't

    You don't need an exchange, it is only a software problem. Kies is notorious for ****in things up. Plug it back into kies and see if there is an update if not go to samfirmware and get the correct original rom (you may need to use a network rom if you are sim locked) flash it with odin and all will be well. As long as you are flashing a genuine signed kernal the flash counter will not be triggered and your warranty will still stand, MAKE SURE IT IS THE CORRECT ROM ESPECIALLY IF YOU ARE SIM LOCKED.

    My phone is SIM free, but when I installed the stock ICS I was informed that it was a custom ROM install before I clicked start.

    Unless Odin has been changed, I think it will count as a custom ROM no matter what software is used.

    Was it definitely a signed kernel, in fact scrub that canker you know what your doing. After you flashed it do you get the yellow warning triangle at every start up, if not then by rights the flash counter hasn't been triggered. Just as an added note the flash counter can now be reset anyway according to then clever lads over on xda

    No yellow warning on startup. But I was warned before the flash started that it is a custom ROM & did I wish to continue.


    I am aware the counter can be reset. I'm not bothered by it myself. But if there's still a chance that a warranty claim could be made, it should really be signed off by samsung first, just in case.
