    Pirate bay

The Pirate Bay Moves to .SE Domain To Prevent Domain Seizure
After the court case against the founders of The Pirate Bay was concluded today, the operators of the site quickly moved to change their domain name from .ORG to the Swedish .SE. A Pirate Bay insider informed TorrentFreak that this move was made to prevent the US authorities from seizing the domain, which is a serious risk now the court case has completed.
Earlier today Swedens Supreme Court announced its decision not to grant leave to appeal in the long-running Pirate Bay criminal trial.
This means that the prison sentences and fines against the defendants are now final. The Pirate Bay website itself, however, wasnt part of the trial and will remain operational as normal. That is, unless the US Government chooses to intervene.
In 2010 it was reported that both The Pirate Bay and MegaUpload barely escaped a domain seizure. Although it wasnt entirely clear at the time, one of the assumptions was that in the case of The Pirate Bay the pending trial against several people involved with the site acted as a roadblock.
Today this last barrier was removed. And with MegaUpload also out of the way, the largest torrent site on the Internet is now a prime target for a domain seizure.
The people running The Pirate Bay are aware of this risk and quickly redirected the site to a Swedish .se domain, outside the reach of US authorities. A Pirate Bay insider confirmed this morning that this was done just in case ICE has been waiting for the court case to be over.
Along with the domain change The Pirate Bay team delivered a defiant message.
2012 is the year of the storm. The Pirate Bay will reach an age of 9 years. Experiencing raids, espionage and death threats, we're still here. We've been through hell and back and it has made us tougher than ever, they begin.
Our 3 friends and blood brothers have been sentenced to prison. This might sound worse than it is. Since no one of them no longer lives in Sweden, they won't go to jail. They are as free today as they were yesterday, they note, adding:
In this year of the storm, the winners will build windmills and the losers will raise shelters. So flex your muscles, fellow pirates, and give power to us all! Build more sites! More nets! More protocols! Scream louder than ever and take it to the next level!
Although it's clear that The Pirate Bay lost a battle today, the above statements signal that the war is far from over.

The guys who run pirate bay aren't even in Sweden, they aren't stupid enough to live in the country where they have been heavily fined and sentenced to imprisonment.

In the case of Megaupload I think the US are probably applying laws passed for other purposes to extradite him to the US to face charges that under normal circumstances no free state would extradite anyone for. Similar to people here being extradited to the US using legislation that was passed to make extradition of terrorists easier.

It appears anyone who makes a fast buck is now a terrorist...

Pirate bay are going to announce a new downloading system next week, to get round a global crackdown, this is after the high court in London said it will make a decision soon whether to make UK ISP's ban the site.

In a statement on its official Facebook page, the site said that from 29 February it will stop offering downloads via torrents which allow users to download music or films directly from their internet browser, and switch to so-called "magnet links" where users do not download files directly from the website.

File-sharing site Pirate Bay faces being blocked in UK after High Court rules it infringes copyright

The Pirate Bay website has been 'cloned'

The Pirate Bay, one of the world's most popular file-sharing websites, faces being blocked in the UK after the High Court ruled it and its users are infringing copyright.

The judgment, handed down on Monday, came in a case brought by music copyright holders seeking an injunction against the website.

The Pirate Bay acts as a searchable index which allows users to download files from each other.

The most popular files shared are copyright films and TV series, music and software.

In his decision, Mr Justice Arnold acknowledged that the site had made no attempt to stop copyrighted films and music being shared among users - even though it would have been able 'to prevent infringement of copyright, should its operators so wish'.

In fact, Mr Justice Arnold said the operators would 'induce, incite or persuade' its users to share copyrighted files, and that it made money by doing so.

He knocked down the argument, used by The Pirate Bay's supporters, that the site hosted no copyright material - in the same way as Google - and that it was individual users responsibility.

'This will have no effect on serious infringers, nor will it help boost the creative industries. Yet it does encourage the assumption that censorship is a reasonable policy...'

                        - Peter Bradwell, Open Rights Group
                        Mr Justice Arnold concluded:

'[The Pirate Bay] go far beyond merely enabling or assisting... I conclude that both users and the operators of [The Pirate Bay] infringe the copyrights of the claimants.'

While the ruling will obviously be welcomed in the film and music industries, and will help clarify the law on the blocking of websites, it has angered campagners for digital rights, who say this is just another form of censorship.

Peter Bradwell, of the Open Rights Group, told ZDNet that the blocking of the site would be 'technologically naive reaction that is both pointless and dangerous'.

He added: 'This will have no effect on serious infringers, nor will it help boost the creative industries.

'Yet it does encourage the assumption that censorship is a reasonable policy response to difficult problems.

This is one in a cluster of worrying and over-reaching proposals to control what we see and do online.'
