Troubled sports broadcaster Setanta has failed to pay the latest chunk of the ?30m it owes the English Premier League, and will now lose the rights.

The League has threatened to sell the rights to the 46 live matches Setanta has for the 2009/2010 season if the broadcaster failed to make the payment.

It will now put the rights out to auction, with offers needed by Monday.

Setanta has recently struggled to make its payments to the sporting bodies from which it buys television rights.

'Regret'

The Premier League said it had "been working with Setanta for some time to help them continue as the broadcaster of 46 UK live matches for the 2009/10 season".

The Premier League, in agreement with Setanta, stipulated that certain contractual requirements had to be met on or before Friday, 19 June, "to allow the preparations for the 2009/10 season to continue unaffected".

The league added: "It is with considerable regret that we announce that Setanta has been unable to meet their obligations. As such the existing licence agreement between us has been terminated with immediate effect."

The Premier League will now go ahead and auction the 46 UK live matches for the 2009/10 season.

Due diligence

Setanta is running at an estimated loss of ?100m a year, after missing subscriber targets.

Earlier this week Setanta reopened its website to new subscribers - having closed it for several days.

Late last week, Access Industries, controlled by the US investor Len Blavatnik, tabled a ?20m bid for a 51% share in Setanta.

He and other investors had been carrying out intense "due diligence" - examination of Setanta's books - which was completed on Friday.

However Access has now said it was unable to proceed with a deal with Setanta.

'Issues'

"Access believed that this proposal could potenitally have secured the future of the broadcaster for its customers, employees and for football, provided certain conditions required to put the business on a long-term viable footing were met," it said.

"Regrettably, despite intensive efforts on all sides over the past few days, and despite significant progress in a number of areas, there remain a number of issues which we have been unable to resolve within the time available.

"We are disappointed not to have been able to make this deal happen. Access remains committed to sports programming and will continue to explore opportunities in this area."

One of those which may be interest in acquiring Setanta's 46 games is Disney-owned sports channel ESPN.

'Bad news'

ESPN would not comment directly on the new situation but said it continued "to be interested in rights where they are available and where they make business sense".

Meanwhile James Pickles, editor of industry newsletter TV Sports Markets, said that until Thursday there were expectations that Setanta would pull though.

"It's bad news for everyone - no one is a winner," he said, adding: "It's a disaster for rights holders."

He said it was bad news for Sky because having a competitor such as Setanta was beneficial to it from an EU regulatory perspective, which prevents one broadcaster owning all Premier League rights.

However Sky would be legally free to bid for one of Setanta's two packages of 23 games.

just heard itv are going to bid for the matches, i hopr they do free football again,bring back the old days when everyone could watch

lol.. no its not.. They were due to loose if they didnt pay by today.. which they havent so they HAVE now lost the rights.. every story before was spectulation

Broadcasters are putting together bids for the rights to the 46 English Premier League games which have been taken away from Setanta.

BSkyB and ESPN are favourites to each snap up one package of 23 games for next season, which begins in August.

The Premier League took rights back from the Irish firm on Friday after it missed a payment deadline.

Interested broadcasters have been given until Monday to lodge bids - which may fall short of what Setanta was paying.

Setanta is still broadcasting, however BT Vision has said that it has suspended further sales of the channel to its customers - who previously could buy it as part of their television package, or as a stand-alone channel.

Disney time?

BSkyB is expected to buy the package of Monday night games - which is has already won from 2010-11 onwards.

"That's the most likely scenario. It would be a neat fit with what they already have, and what they will have from the season after this one," said James Pickles, editor of industry newsletter TV Sports Markets.

"And it would earn them some more brownie points with the Premier League if they stepped in to help out."

EU legislation means that BSkyB cannot own all the rights, however, and Disney-owned ESPN are favourites to buy the games which take place at Saturday teatime.

ESPN has refused to comment directly on whether it would bid for Premier League rights, but has said it is "interested in rights where they are available and where they make business sense".

There is uncertainty over what will happen to the 23-game deal that Setanta has already won for the three seasons starting in 2010-11.

But analysts expect that if those rights were up for offer again, a tender process would be resolved quickly.

Scottish focus

Setanta missed a deadline of Friday to pay the latest chunk of the ?30m it owes the English Premier League.

A potential rescue deal from Access Industries, controlled by the US investor Len Blavatnik, fell through. It had proposed buying 51% of Setanta but there had been concerns over how much tax Access could be liable for if it made the acquisition.

The Premier League said it had been working with Setanta "for some time to help them continue as the broadcaster".

Attention will now shift onto Setanta's other contracts - such as those with the FA for England and FA Cup matches, the Scottish Premier League (SPL), and the Blue Square Premier, the top division of English non-league football.

It recently missed a ?3m payment due to the SPL - part of a four-year deal worth ?54m over four years from 2006 to 2010.

Setanta also owns rights to the PGA golf tour, as well as cricket and rugby union deals.

Setanta is running at an estimated loss of ?100m a year, after missing subscriber targets.

The broadcaster has 1.2 million subscribers, 700,000 short of the 1.9 million that industry experts believe they need to break even.

ESPN, Sky 'submit SPL offers'

ESPN and Sky are understood to have tabled bids for television rights to SPL matches currently held by Setanta Sports.

According to press reports, ESPN has offered 90% of the ?125m paid by Setanta for the television rights to SPL matches for four years starting in 2010. Sky is reported to have offered between 60% and 70% of the amount.

Lex Gold, executive chairman of the Scottish Premier League, said the SPL was "still in discussions with Setanta" which he expected to "conclude early next week".

Setanta US retains Premier League rights

Setanta's US operation has announced that it will continue to show Premier League matches despite yesterday's termination of the agreement between Setanta UK and the League.

"As has been widely reported in various media channels, Setanta Sports has today had its agreement to broadcast 46 Barclays Premier League matches in the UK terminated.

"This development does not affect our channels and other services in the US.

"Setanta Sports in the US is a separate operation that has separate agreement to show the Barclays Premier League. Our channels and other services in the US continue to broadcast and our subscribers can still enjoy our programming including the Lions Tour of South Africa and the UEFA U21 European Championship."

Setanta US is continuing to accept new subscribers. Setanta in Canada is similarly unaffected by the turmoil in the UK, as is Setanta Australia and Setanta Africa.

BT Vision pulls Setanta sales again

BT Vision has pulled sales of Setanta Sports for the second time this month after the Irish sports broadcaster lost its Premier League TV rights.

In a statement, BT Vision said: "Following the removal of their Premier League rights for 2009-10, we have suspended further sales of Setanta Sports to BT Vision customers.

"The channel is still broadcasting and we are in on-going dialogue with Setanta and other relevant parties as the situation develops.

"Due to the on-going uncertainty surrounding the broadcaster we have already reviewed our offers to decide what we can provide BT Vision customers who are receiving Setanta Sports within a Bronze, Silver or Gold Value Pack or as a paid service in the event it ceases broadcasting.

"There is no need for you to call in. We will be in direct contact with all affected customers within a few days of the channel ceasing should this happen.

"In the meantime please ensure you retain your BT Vision/Setanta Viewing Card.

"No other aspect of the BT Vision service is affected."
