ok here is the gist of the question, thought i would try to see if i was banned as i am hearing people being banned, without even being on live before ,anyway i tried the tutorial about no hard drive connect to internet etc etc,
any way soon as i ask to connect network settings i get a message in box saying xbox live up and running ,then i get the message saying i must update to connect to live etc etc ,does this mean i am not banned or is it a ploy by microshaft to get me to load the latest up date which will effectively kill my hopes of going live ,sorry about the question as to some it must be a dumb on ,but i aint never been live before ...cheers in advance

By forcing you to do something to use thier product, if you want to better yourself or join in on thier terms.

Updates are there for gaming use. The only thing they force is for you to pay for the privilage of going online.
Everything within that (by that i mean the updates) is to better that experience.
No-one forces you to play online and if you mod the console and the update upsets you then either dont mod or accept they will catch you from time to time.
Either that stay offline mod away and enjoy free gaming.

So by this logic my human rights are being removed because i need to get dressed to be in public?
Microsoft dont force people to do anything, theres no gun at your head to use live.

Good work.
I lasted 3 years. I have a new box and im just waiting for the LT firmware. Evryone i know has been banned but i know a lot of people haven't.
I checked every disk with abgx and never played games before release date. Yet you have people not checking disk, playing early and aren't banned! Doesnt make any sense!
I personally think M$ can detect the firmware but only pick a selection of people to ban. They then sit back and laugh at all the forums of people wondering how they detect us!!
