Seller Refusing To Refund Or Replace Faulty EX7000 HD

Hi all, last Tuesday I bought an EX7000 HD from the computer market at dunstall park, Wolverhampton. When I got it home I found out I had a faulty box. "Now Booting..." appeared on the LCD for about 5 seconds then it went black (as if the box turned off). There was no output to the TV at all either via HDMI or Scart, and there never has been any output to the TV.

I tried updating the firmware in case thats what was wrong but again no luck. After asking a few people on various forums I was told the box was faulty.

Anyway I took it back to the market yesterday (its on every Tuesday). The seller opened the box and found the serial number on the Eurovox didn't match to that on the packaging. Also the box was scratched, in a used condition. It was like this when I got it out of the box, I put it down to them testing all the boxes before they sold them.

He told me that serial number on the Eurovox didn't match to any he's had in. Obviously this wasn't my fault, somewhere along the line the box had been switched to a faulty one. After an hours arguing and getting the event manager, we came to the agreement that they take the box back to their supplier (who i assume is in China as they get most of the stock from there) and try and find that serial number on their database and find out where the box has come from.

He told me he bought 5 from their supplier, the large box of 5 was sealed so he didn't check the actual serial numbers before hand. He assumed they were fine, when they obviously werent and didnt match to the packaging serial number. Surely that is their fault!!

So at the minute I am ?170 down and without a faulty box.

I posted this on another forum last night and someone replied saying they bought one from the same supplier last night and exactly the same thing has happened. Im awaiting a reply to check if the serial numbers match on the packaging and the box, which I assume they wont. So thats 2 of us with exactly the same problem. I have to go back next week to see whats happening.

Sorry about your experiance you have been well stuffed. The other major thing is that the Eurovox warranty becomes null and void as soon as you put any other firmware on it, sobering thought for everyone who might think they have got 12 months warranty.

If you got a receipt you're surely due a full refund as the item isn't fit for the purpose you bought it for (I appreciate their claims about the serial number) and as there are at least two of you claiming the same problem then threaten them with court action - together - add your costs to the bill for this and relay all of this back to the event manager. Basically make this as uncomfortable as you can for them.

Hi all, sorry for the late reply.

I've been to the show tonight to see whats happening. The Chinese lady said that the box is with their engineer to see if they can fix it (which I think is total BS). She said she checked with her supplier to see if the serial number was on their database and it wasn't. She basically said we have changed the box due to the serial number not matching. She said if they can't fix it, then we will have the faulty box back next week.

I threatened them with trading standards and they basically said you can do what you want. I'm not happy even if it gets repaired because it is a used box, it was scratched anyway, I didn't even realise how bad it was until I got to the show to return it last week.

I think the next step is trading standards, but how would I go about that considering its a Eurovox?

don't worry about it being a eurovox, inform trading standards. Ultimately there is nothing illegal about buying a eurovox and using it to view fta channels. It is against VM terms and conditions, but that doesn't make it illegal.

As long as you haven't used it to view subscription channels (which you haven't as it doesn't work) then you've done nothing wrong. I'm sure however, that trading standards will cause them more trouble than is worth their while.

You should take a look at your Consumer rights.

You bought a box in good faith that it was working ,there by entering an agreement with the seller that it was working and took it home, you set your box up and the said box was faulty and does not work and you took it back.

You are entitled to either a full refund or a brand new replacement box, that?s the law. Personally I would have opted for a full refund as it is obviously a cheap Chinese clone.

I would suggest going back and threatening to get the Police (selling snide gear),threaten them with trading standards, phone the police whilst your there if need be and say the seller has just threatened you nudge nudge wink wink, cause a few ructions.

I can?t see them wanting any heat from the odd lot for the sake off one cloned box running the risk of bringing down the entire operation.

I think you have dealt with it wrongly I would have been incandescent with rage.

Exactly he has no firmware on it, and even if there is he blames the seller.

                    Cant stand rip off merchants.

That?s why when buying a box one should check if adding firmware will automatically null and void your warranty.

Reputable dealers will replace faulty boxes regardless of firmware, where as a doddgy dealer will use this excuse for everything.

A point worth remembering when buying a box..

                      Read the small print first.

Thanks for the replies guys. To be honest my dad was going mad last week when they refused it. Tonight when I threatened them with trading standards she basically said you can go where you want.

When I bought the box I did ask about where to get the firmware from, and he gave me a disc with the March firmware on it. So he obviously has the firmware under the counter.

Just make sure you stitch the robbing cnut up regardless off what happens.

Maybe a couple of anonymous telephone calls to the right places should ensure a bit of heat for him. Does he have a VAT number on your receipt ?,if not why not ?,is he registered at companies house ?

Right i've been once again to the show tonight. I didn't get time to go over as I was sorting stock out with my supplier but my dad went. The lady said that the manufacturers are in the process of fixing it, 2 parts were needed and she should have had it back this week but it hasn't come due to the postal strike. She said 90% chance it will be fixed, 10% it won't.

My dad asked for their address and she asked why, he said if its not resolved by next week then we will be going to trading standards/courts etc. She turned nasty then. She asked for our address, she said she has photographic evidence and fingerprints to show the box isn't theirs and we're lying (?!). She then threatened us saying she will go to every trader at the show and say we're bad news and also try and get us barred from the show. She said she has friends who are lawyers and know the law inside out and if we take it further we will lose. What a total bitch. My dad just left it after arguing then and said we'll see what happens next week. We've given them too much of an easy ride so far I think!

yes shes speaking rubbish ,I sell eurovox and faulty boxes are repleced without question by the importer ,spare parts are not provided by eurovox other than psu boards and remotes , eurovox do not repair faulty boxes they are binned ,the fact that you have been sold a used box would indicate it was faulty to begin with ,ive also sold at pc fairs and if you have a problem with any trader at the pc fair then the orginisers will normally sort out any problems
