    compo claim

    hi all, on tuesday the mrs fell over not 2 far from our house and broke her shoulder,we have taken photos of the footpath and the paving flag that dropped almost 2 inches at 1 end and raised the other end,the flag does wobble when you stand on it.we have never made a claim b4 and with my work very slack and now my mrs is going to be off work for at least 6 weeks we thought this might be the right way to go.we also have 3 people who seen her fall and came to her aid. any advice would be most gratefull. many thanks nicole

      sorted they visiting us tomorrow,the mrs dont want the bother but ive told her to just tell the truth and see what happens.

          ive got the hoover tied to my arse and a dish cloth in my had,will they pay us for fast food for 6 weeks as i dont think i can fit the cooking in!!!

                Take them for wotever you can they wont have a leg to stand on so to speak councils are all useless...........

                  Yes claim off the council, then we will all pay more council tax next year to cover the cost.
                  Its a vicious circle.................The money has to come from somewhere.

                    Make sure you have something in the pictures that shows the depth of the drop. The claim limit is greater than a 50p piece in height.

                      i pay tax and so does the mrs .whos going to pay her for the 6 weeks off work and our loss of income.2 be honest i would rather not claim but if i dont pay my bank loan back for the house i will lose it as the figers dont add up with just me working!! i am not a parasite spongeing off the state but think i deserve somthink back in a time of need.

                        the council will only be liable if they are found to have been negligent. The fact that the flag is clearly broken does not prove negligence. Basically, they have a duty under s81 of the Highways Act to maintain the public highway at the public expense, but they have a defence under s58 if they did not know about the defect and could not have reasonably known about it i.e. they inspect the highway regularly and on time (according to the street's classification in 'Well Maintained Highways - the code of practice for highways maintenance)and the defect wasn't there and nobody reported it since.

                        Each council sets their own intervention levels - usually 25mm but some have 20mm and some 15mm.

                          My missus had a similar fall a few years ago.Council told her that the trainers she wore that evening were the wrong ones?(fashion police)-blamed her for not stepping out on roadway to avoid their incompetence -ended up in court and the missus won 2 grand and oddly enough.....the footpath was fixed post haste.
                          Just stick to the truth-expect the brow beating from them and don't flinch and you should win.
                          Best regards to your missus-you keep the chin up and get on with your household chores-and best of luck with the case if you go ahead with it.

                            pat thanks,solicitor seen the offending flag and said its a open and shut case,just hope the mrs picks up as shes not been very well since.

                              Unfortunately it's not as simple as that. Yes tell the truth because you could end up in prison if you get caught lying - like this fella from Wigan BBC NEWS | UK | England | Manchester | Man jailed over fake fall claim, but councils will defend any claim which they think they have a strong defence for and will let you take them to court. It will then come down to a judge's decision and they can go either way.
