    hope some one can help got a acer netbook from littlewoods home shopping had it 6mths and it blow up been on to littlewoods to send it back and they told me not there problem sort it out with acer am i right in saying that my contract is with them and not acer after 3mths of emails and phone calls still no futher foward please help

    I hope i am right in saying this ;

    All electrical items come with a standard 1yr garentee which meens Littlewoods must replace the item , but only if it is defective. ie; not damaged by the customer.

      thanks for that but am i right in saying if i dont want a replacement am i in my right in askin 4 a refund

        i would say yes you are within you rights to demand a refund . your best bet would be Google "The Sale of Goods Act 1979"

              opinions are only opinions , the sale of goods act is law.

              just quote the bits that apply to you and littlewoods should do what you want.

                  goods have to fit for purpose regardless of age- If you can prove they are not you can go to small claims court for refund. Contact trading standards.

                    Simply inform them that they have a statutory obligation to deal with your problem under the sale of goods act and if they refuse then you will start legal proceedings against them.

                    The act states that any goods that fail in the first 6 months (and have not been abused) must of had an intrinsic manufacturing fault and were therefore unsaleable. This obliges the RETAILER to either refund or repair the item (at the CUSTOMERS option). The sale of goods act takes precedence over any other warranty or guarantee thus preventing the retailer from defaulting on their statutory obligations.

                    After 6 months things start to get a little blurred as the concept of 'durability' enters the picture. Durability is effectively the time a particular item could be expected to last. For most consumer electronic items this is at least 12 months but can extend much longer (Fridges/Freezers etc can be 36 months or more).

                      sorted, thanks to all and a special thanks to thecorder picked bits out of your message and emailed them and after 3mths of no responce would you believe it they replied to me. laptop was sent back today refund on it way.once again thanks.

                        Its just a pity that people have to threaten to resort to legal remedies before retailers take note - they all know the law so it should never need to get that far.

                          agree if the warranty is with the seller how the hell do shops get away with saying its not there problem when the law is the law?
