    legal advice

    hi all the situation is thi s
    I booked a sea fishing trip over the phone and paid a ?100 deposit direct to the guys bank account before the trip i became ill with burst appendix and scepticemia and was in hospital for some time very ill th due to this i was unable to contact the guy to let him know the skipper text my phone the day of the trip and my mrs replied with the situation to which he demanded payment in full of a futher ?800i am now better and out of hospital and just wondering where i stood with this ?

    no contract was signed i recoeved no terms or conditions and no mention on the phone abpout cancekations,

    Tell him "the cheque is in the post"
    cheeky bugger he as already had ?100 for doing nothing.What happen if he canceled due to a broken thingy on is boat.Would he give you compensation for your lost time not a chance.

      then wipe ya ass on it
      and put back in the envelope with ur address crossed out and return to sender written on it

          as the rest have said tell him to do one


          even if you had signed a contract he would have to take you to court to get money and i think a judge would laugh it out especially if you have medical evidence

          as you havent got a contract he should think himself lucky he got ?100 for nothing and been a bit more sympathetic

            You paid a deposit... which of course you have lost, as for the rest of the money... where have you signed to agree to pay if you don't turn up... you havent and therefore you don't have to pay...

            I wonder who else he has tried this with, ring consumer direct, they will put you right and give you a reference number... don't let anyone else fall for these bully boy techniques and then at least they have record.

            but if you can't be bothered with all the hassle, tell him where to go...

              You paid ?100 deposit and he is now asking for ?800, and that?s for sea fishing.

              Do not get me wrong but why any 1 wants to pay nearly thousand pound just for sea fishing??????

                Yep,,, He definitely does not have a leg to stand on; that is = As long as you were not provided with any T&C's. If you booked on tinternet and T&C's where attached, he may want to take it to court.

                  I would just ignore him.
                  I would let him take it to court if he wanted.
                  Given your medical emergency he should be a little more understanding.
                  I hope the next time he has to cancel a charter the people tell him to pay extra for their wasted time.

                    the trip was for 20 people i organized it but fell ill and obviously could not contact him to let him know the boat cost was ?45 per person no other monies from anyone they was going to pay on the day obviously they knew as i was ill it was not going to happen but no one could find the details to contact the skipper it was not saved in my phone one the day of the trip he text my phone which my mrs had and asked if i was on route to which my mrs replied with the situation and a reply demanding full amount in his account was sent back

                      u didnt say it was a group booking
                      why didnt the rest of the group go?
                      if i was the skipper i would be pissed
                      he lost a whole day of trade

                        Now that is a bit different. Given that part of the story I think you should ask everyone else why they didn't go. The other people could have still went. I could understand you and your immediate family not going but not the whole group.

                        No wonder he is asking for payment. You may not have signed a contract with him but also I feel he had an agreement with 20 people not just you.

                          no one knew the full details of the trip so was not possible for them to go or no way to contact him i was the organiser alls th rest knew was it was in wales and we was to meet at 6am for a coach. the coach company was contacted as they knew the firm was a local one but as for the skipper no one knew who or where he was based the coach company only had a hotel to be dropped off at in wales.

                          yes he probobly has lost a full days which i really could not help i never expected to nearly die and end up seriously ill.

                          i dont exoect the deposit back and if i could i would have contacted him myself to let hi know before hand.

                          and also most was immediate family.

                            He has a verbal contract with you. His staff and fuel costs may be high plus his loss of earnings. Ask all your fishermen to offer him 5 quid a head or change your number and take up golf.

                              Morally, if not legally*, you owe him some money - next time do it properly, get everything in writing, arrange insurance cover and make sure the details and contact numbers are written down.
                              If everyone else had gone and the boat had sunk, who do you think the families would sue? The dead fisherman or you??

                              *Not sure on the "Verbal Contract" legalities of this.
