    Pulled in by the cops

    I got a pull today from the cops in Scotland. They said I had went through an red light. I told them the light was amber and that it went amber about two yards from the stop line. I told them it was unsafe to stop and that I had carried on lawfully. They never charged me or anything, but they did ask me to leave my vehicle and go into their vehicle, which I refused to do. I could see this irked them and they done the standard roadside checks at the side of the road.
    I've been searching the Internet to find out exactly what my rights were in this situation but cannot find anything concrete. Can anyone confirm that a driver can indeed refuse to enter a police car unless he or she has been arrested.

    First of all always obey the officers, when they tell you to sit you sit, stand you stand, by the look of it if you would gone inside police car and told them that you were sorry they might have given you the warning and let you go, they can now stitch you right left and centre?. soory mate not looking good.

          If you HAD to go into their car when they asked, they would have MADE you. Coppers will never fail to use brute force if they can get away with it. However, you haven't done yourself any favours, particularly with THOSE coppers. if you get stopped again, make sure that it's not by those same coppers or else you'll find yourself 'married' to Mungo in Strangeways before you know it.

            I'm surprised they stopped you, that would have either interrupted their internet surfing or their coffee break. Certainly it's not normal to be stopped by a police office while driving your car, normally they take photos and send you the tax demand in the post. All I can think is they wanted the amusement of actually doing their job for once, even though they are quite often mistaken - perhaps this is because it's been so long they have actually forgotten the purpose that they are employed for.

              Running the amber for safety is correct and having to explain the reason was a bit silly on the part of the wops. As no crime was committed or suggested, then you were in your rights not to enter their car.

              I'm speaking in terms of Irish law and I don't suppose it's much different in Scotland as we seem to copy everyone elses laws due to a massive deficiency of brain cells in our elected clowns.

                In our country we get in their car because they don't want the public to see them accepting bribes.

                  They can ask you to leave your car but you are not legally obliged to do so! You are also not legally obliged to accept the charge and can do so by simple saying 'I will not be accepting any paper work from you today' however you will receive notice of the charge at a later date (via post)
                  You are within your rights to dispute the charge as you did and you may and should ask to be quoted the exact code of the law you are suspected of Breaking as it's info they are required by law to provide you. It's a good idea to record the event as soon as you get stopped if you have a camera phone start recording, if you do this you must state to the police before anything else! Do so by saying 'for your information I am recording you' you are allowed to record in a public place so you are not breaking any laws and will ensure you are treat with the respect you deserve.                   Ps You can always ask the police if you have to comply by asking if thats an order or a request.

                    I got pulled for no seatbelt and that went to court. Once there I questioned the policeman and presented my case quoting the relevant part of the act that states if you are doing a manoeuvre involving a reverse there is no need for a set belt until the manoeuvre is completed.

                    The magistrates asked if I had brought the road traffic act with me, this was gobsmacking, how is it that you can be tried in court for an offence when that court doesn't know or even have a copy of the relevant law that you are being tried under.

                    They refused to take action against the policeman whom I had proven to be lying under oath.

                    The whole thing is jsut a joke, it's not justice and hasn't been for a long time.

                      Can't remember what it was but I was in court a 'every day' word was mentioned, can't rember, DVD, weed, tweet, Chav, bike, ped, iPod, iTurd, iShit, DK. Can't remember but a small annoying child would have know what it was, judge stopped the case and had to ask what the word meant.

                      judges seem to be VERY low knowable of real life.
