    Redundant

    Just thought i'd let you know that my employers put the padlock on the gates on friday....so thats about 100 on the street...start consultation on monday morning...just wondering what to expect with 8 years service...heard that you might get more if the factory shuts all together.....feed back gratefully accepted

    if there broke u get nothin m8 .. u have to make claim to goverment , the liquidators tax and vat r first to get paid and then u l think ,,

        so they are not closing the place due to insolvency then? It seems they are not bust just relocating/closing that location on the sly to avoid the protestors and saboteurs and will therefore have to make a compensation/redundancy payment to you from their own coffers..

        If a company goes into administration or liquidation then there is normaly no chance of getting much money back, on average a 1 - 5p in the pound.. After the liquidators are paid out first the banks get paid next and then any other decured loans and debentures (basically all secured creditors get paid out first), if they get paid out 100% then its the government in the form of the HMRC to see what it can get back. If there is any money left after then the unsecured creditors get what is left,, normally next to nothing or sweet FA...

        The government pays out via compensation scheme which is something like a week for every year you have worked, but this week's money is not your level of pay its a set amount stipulated in the compo scheme for everyone.. Its not much and takes ages to be paid out.. Once the company has either been sold as a 'going concern' or its assets liquidated and the books the company is dissolved but i remember rightly the compo payout does not need to wait for the end of the liquidation as these can go on for years.. The liquidators will liaise with the goverment department and sort the compo for you..

        Its been about twenty years since i was in that business, not what i expected and after a told my boss to FO back to the golf course i unceremoniously walked out the buidling having decided that i would never work in that type of business again...

        If there are insolvent then the accountants will be working to get as much money from the assets to pay back the creditors and you will be invited to attend a meeting where they will lay out the situation to you all. They do a thankless task and people will call them all sorts of names but remember they did not go in themselves, they were appointed by the banks or goverment to sort out the mess.

          no m8...they want to get all production done near where the engineering dept are...we only had 1 guy do that job down here ( east kilbride)

            americans killed my old work too you should get statutory government redundancy which is a year for every full year of service at a maximum of around ?340 per week ( i think not 100% sure)


            if your over 40 i think it amounts to a week and a half for every full year

              hmmm.....so thats a week and half for 6 and a week for the other 2 of service....now would that be taxed or is it the lie time thats taxed........is that the same...ie. a week for every year thats served

                should be tax free m8 i was wrong by the way its ?380 a week maximum not ?340

                thats assuming your wage is/was over ?380 per week otherwise you will get what you earnt per week

                  cheers m8....?3990...so lets hope we can negotiate some more out of them at tomorrows meeting...we have had 2 payoffs in the last 6 months and from what i heard they were generous and paid the full amount of pay per week which is a bit more than 380

                    hopefully you can get some more m8 good luck with it as under normal redundancy i think they are supposed to give you notice too

                      Jasbo7, sorry to hear of your predicament and I wish you good luck for now and the future. I`m not sure if a union is involved in the negotiations and perhaps your redundancy laws are different to ours but ours means that you get 3 weekspay for every years service(more if you are over a certain age-50 I think.The union ,if there is one shouild be looking for more than your statutary rights and depending on the company-if they are a big brand name-may agree to a better deal.Other than that I cannot comment but can only commiserate with you(I`ve been through it three times) and once again to wish you good luck. As a last and militant approach- you can picket the factory in the hope of preventing machinery being moved (TWO Mates and myself done this back in the 80`s and we moved to the new company with the machinery. In hindsight this was a ploy by the company to get their way as they soon after made conditions awkward for us and after 9 months we left and came home) Just needed to mention that,.

                        no there is no unions involved m8...we have to do it all by ourselves so any help will be gratefully accepted

                            just spoke to one of the guys who got bumped at the last payoff and he told me that they offered an extra payment of ?1700 if they signed some paperwork not to contest their offer....which was based on full pay....probably about 30% more than gov max i think all told
