ok then, let us conduct a short scientific experiment,as you are a taxi driver it is best that you prove your theory, pick a nice well lit street with multiple cctv and a suitable target.

when the police arrive (and they will) explain your side of the story and see if they agree with you or prosecute.

please let us know the outcome

im very sure that if the cctv shows someone texting then walking out on me without any warning, then i will be completely absolved of any blame. Much the same as a child running out on you between parked cars. Ps- you dont get what im saying clearly by asking me to pick a target. What target it would happen almost instantaniously and completely by surprise.

no you will not m8, the police will prosecute (trust me) as the driver of the motor vehicle is the only party legally accountable, hence the need for insurance.
there is at this time no requirement for jay walking laws as the onus is on the vehicle and there is no need to implement anything as long as the driver drives with awareness at all times.

Mate youre saying that if im driving along and a pedestrian walks out from absolutely nowhere texting on a mobile phone and not looking where they are going then its my fault i will get prosecuted if i cannot stop in time and hit them, even if cctv clearly shows i could not stop in time, i think you are talking absolute bo**ock*.

I wonder why several other countries in the world felt the need to sanction jaywalking legislation.

guys i am a taxi driver also, and a few years back a guy[drunk]ran across the front of me from one of those islands in the middle of the road,he had waited for a van to pass then decided he was going for it,he never got to the other side as i couldnt avoid him and knocked him up onto my bonnet,as always the local cops turned up first and then the traffic boys, but what stopped me from being charged was the guys wife who told the cops that her man had ran out in front of me,and the van driver backed up her story.

i think that kind of backs up johnboys point.

and i also would like to see jaywalking laws brought in

About a year ago, while out playing pool with friends, we had the opportunity to watch someone step out in front of a taxi.
He was launched a good 12ft into the air before landing on the roadside. It was an amazing sound that makes me smile every time I think about it.
Police & ambulance turned up, attention seeking barbie dolls walked around screaming. The taxi driver was questioned & let go. The moron, pissed moron, started fighting with the police & was arrested & thrown into the back of a van.

Going back even further.... A guy, pissed, stepped out in front of a bus. He was knocked about 8ft along the road & people there covered him over as he had no signs of life.
5 mins later when the police & ambulance turned up, the coat that was used to cover him up....... sat up.
Oh the screaming from everyone watching at the scene was hilarious.
He also started to fight with the police, ending the same way... chucked into the back of a van & locked up.

well, i need to move near you lot.
am a hgv driver and got nine points last year for taking out a cyclist who was weaving in and out of traffic (on cctv i might add)

in court i got told that as a professional driver it was my responsibility and the cyclists version was accepted by the court due to his age (48) and the fact he came across as a viable witness.

and to cap it all was also told that if i appealed and was unsuccessful it could see my points increased to the 12 point threshold as well as the ?750 fine innitially given could also be increased as well as court costs.
i can only speak from personal experiance and i still think jay walking laws are useless

                    better idea.....

fit cameras to all vehicles and just run over every b*st*rd who doesn't watch the traffic.
the video can be used to prove that it was the pedestrians fault and not the drivers

Trouble with cyclists is you have to give them extra room to weave in and out and all over the place as they could be affected by wind. I always stay well clear of them about a bus width when overtaking. Tells you this in the highway code.
