    redundant

    i was made redundant from a garden centre a month ago they said they were going to selll the plants we had at half price and the ones that didnt sell were getting dumped,and that they werent buying anymore plants in,since i left i found out that they bought plants in to grow on,they also said the part of the buisness that i worked in was getting shut down.the guy that worked with me was term time and meant to finish up on the end of september,he is still there.they also got young boys after i left .could i get him for unfair dismisall or do you think i have waited to long i left at the end of august.basicaly could i get more money out of him as i think he is breaking the law keeping my other workmate on who is just short term (ie summer).do yous think i should go se and advisor.......

    Certainly speak to an advisor. If you are made redundant you can't be replaced by someone on lower wages. A lot also depends on how long you have worked for the company though.

        You are in with a shout. Off the top of my head you can't be replaced in the same job for 2 years after being made redundant. The idea of laying someone off is due to their being no longer a post to be filled.

            As mentioned, when they made you redundant your job ceased to be and should only resume with either you doing it or you rejecting the offer of it.

            I would seek advice on the situation from a Citizens Information Center or I'm sure there's info on your Governments website.I'm sure you have a case to bring and my best wishes to you wulbert for the future.

                they have to explore all possiiblities before they make you redundant. most companies are clever by employing somone under a new job title

                        cheers .....will i still b able to get him even though i took my redundancy package... which wasnt much...six feeking grand .....for 33 years...the guy that is term time is working in the garden centre fixing all the xmas shit .he isnt in my department i was in just now but if he got laid off thats the job i would be doing really annoying......

                          IIRC companies only have to pay you a maximum of 20 years at a maximum of ?400 per year or less if you don't earn ?400 per week

                            thought it was either 1 weeks wages per year.

                            Now if it was one weeks wages per post 7886 here - that would be cool.
