    help needed with employment laws

g'day, a few weeks back e-on advertised an internal job. i and a few others applied for it. 2 weeks later we all received emails saying that the job had been pulled, and that due to the redundancies they where making it was not 'good form' to be seen employing people.

today a chap has been intoduced to me as the new trainee in the above mentioned job, no interview process no ~~~~ all. i have had a word with the union rep who says its'unfair process'.

anyone got any sensible and/or informed answers for me please.

    mick.

i have heard and learned enough during my 6 months in the office to cause a right unholy row. also scottish power have offered me a job with more money anyhow.

whats right is right, the end.

By law, anyone under notice of redundancy has to be offered the chance to interview for a another similar level role in the company which they may be suitable for. Of course shop floor can not apply for directoer etc.
They would also have to prove that they are qualified for the role they aew applying for.
Jobs need to be advertised internally as well as externally, to give people the opportunity to apply if they so wish.

You are spot on m8 if you let the ~~~~ers away with it once they push a little further the next time and before you know it the people being made redundant won't get what's due to them and there positions will be renamed and offered to some dumb ~~~~ that will work for less and keep his mouth shut.....because we all know all management would prefer to employ a doormat than someone with a bit of savvy that can think and stand up for themselves......in fact I'll rephrase that management would prefer someone that can think for themselves but is seen and not heard.

the job hasnt gone to someone being made redundant.
its gone to someone doing exactly the same job as me, in the same payband with same length of service etc.

                        it was unfairly gained/given.

You are perfectly entitled to put in a grievance and ask why you didnt have the opportunity to apply. If the answer is unacceptable, you can take it to the next level, even all the way to tribunal if you so wish

i and a few others applied through the proper channels. the job was withdrawn, now this guy has it.
no interviews, not re-listed, just got it.

                            jobs for the boys?????

More than likely, so the two actions you can take are:

                              1) Complain to the union
                              2) Put in a grieveance
