    Car Accident Insurance claim advice please

    I have got a friend of mine who was involved in a car accident not his fault.

    The reason I said not his fault because he was driving on main road and third party car came strait from the Side Street and bang.

    Third party admitted liability in front of the police officer; the problem is with the claim system.

    My friend reported the incident to his insurance company and they put him to contact the claim assistance, the claim assistance will not take the claim because no one was injured in an accident.

    So my friend phoned numbers of claim assistant and numbers of solicitors to put the claim and they all said because you are not injured we do not have much profit out of it that?s why we are not interested.

    Basically what they are saying that if you claim injuries such as whip lass of back pain we will take your claim and get you the money.

    My friend is a trusty person; he said I do not want to lie when I was not injured and in order to reduce insurance claim people taking for granted he said he is not going to lie.

    Are we really living in a fantasy world when a person just wants his car repaired under the insurance law but run into complication, that?s the reason our insurance premiums have rocketed because in order to make a proper claim you have to make injury claim as well.

    His insurance company told him over the telephoned that if you pay the access of ?400 we will try and get the money from third party and when we get the money we will refund your access money.

    What advice any one can give him regarding the claim?

    Looks like all just pay insurance premium and do not know ~~~~ about the claim??

      Jumbe,sorry to hear of the shit situation yer friend is in.

      I'd get the ball rolling,pay the excess,if the cost of repairing is more than that.Otherwise,it's out of his pocket only.I personally don't believe an insurance company would perform on that line,unless the cost of repair is less than the excess.

      As for rocketing policy costs,there would be an element of fraud driving prices up slightly,but I would think that the extreme weather of the last few years,regarding claims,has the insurance companies(Globally) and underwriters under fair pressure.They gotta make money back somehow.

        Funny how you never hear of insurance firms going out of business or needing bailouts or filing for bankruptcy.

            OK - take the car to 3 proper body shop - get 3 quotes SOME CHARGE FOR THIS SERVICE. Then send these photocopies by recored post to the other partys insurancse company - see if the company can send an invoice BEFORE work starts and see what happens.

            Ask your friend does his policy have "uninsured loss recovery"

            As the insurancse company are saying nil poi

            Just for reference your mate had a tv on his front seat on impact.
            Say the accident was 1 wing and 1 alloy wheel only - no other damage.
            the TV that went through the windscreen, the windscreen itself are now lost because of the accident - so you have uninsured loss recovery for the other co to buy a new tv and windscreen.

            The alloy wheel - yes it was a odd ball set from Taiwan - only avalible in sets or 5 - at a cost of ?1000 each.

            The uninsured loss recovery pays for the 5 new wheels - give you one (all your entilted to) and the rest there problem

              hi super jumbe

              i was in the same situation . thats what i do. get estimate from a local body repair shop.
              write a letter to third party insurance company claim your car damage. and also dont forget to threat them like if not response in 15 working days (new legal requirements ) then will take court action. attach ur estimate.

              copy of that letter to third party.

              both letters must be recorded delivered.

                  Meat Head he does not have name and address of the third party insurance company details.

                  Only thing he got from third party when police was present his name and address and car registration, police told him to contact your Insurance Company and he thought every thing will be done by his Company.

                  My fiend had telephone call from the Insurance Company on Friday morning and was told that some company will take the car from the storage garage and he will have to pay the access to them and fortunately he told me in the evening that nothing has happened yet car in the storage.

                  I told him to make more telephone calls to his insurance company why the ball is not running smooth and ask them the name and address of the third part Insurance.

                  Looks like it does not pay to be a trustworthy person!!!!!!!!!!!!!!!!!!

                    Right the word accident and storage in the same post is 'bad'
                    listen carefully

                    1) My mate his car was nicked from outside his house - he got a
                    call fromm the fuzz at 6am to say we have found your car
                    BUT at 6am he was asleep - didn't hear phone the fuzz rung
                    a little later (still early) - to say we have found your car - he said
                    where is it - i'll stick the trailer on and go fetch it - sorry sir it's
                    been recovered by Meat-City-Towing - so he was a crime victim
                    who had to pay ?125 for his own car back - when he had his own
                    trailer (car WAS driveable - he didn't know that)

                    2) My THICK mate sold his Porsche to his even thicker uncle who
                    drove it into the back of somebody - bumper, light wing hood,
                    beyond economical repair - write off - the uncle got paid out more
                    than he paid for the car.

                    8000 posts (TWO years) later the guy (he is dead now) gets a letter
                    from 'somewhere' asking about the car.

                    As it was took to 'Dibber & Dobber Bodyworks' upthe road - went to
                    see them - gave the the reg number - printed out the setails - DIG THIS

                    1) They charged ?300 recovery fee - it was driven there
                    2) They charged ?1700 STORAGE fee - it was outside in the rain!


                    3) Some Doris had a 10 year old 1994 Pug 106 - not sure 100% what happened - but she was 'parked' in the middle of the road some guy - fair enough went up her arse.

                    Car is slightly bent - took ~~~~ knows where - she had a couresy
                    BRAND NOW 2004 Nissan Micra for 5 months or so - then they wrote the 106 off - The money paying for hire care would have paid for repairs to her car!

                    4) Pat***** - somebody tapped him up the arse - if you knew him you would have woundered why not tapped his face!).

                    So his car is slightly bent - boot/rear door not useable.
                    He had a spare car - so he taxed that - he had his bend car at work for a couple of weeks - whilst insurancse decided what to do - i said send insurancse a bill ?5 +VAT per day storage through his works invoice - they paid like ?80+VAT

                    Forgot what was saying now - oh well

                      Friend of mine gone to some computer market as is already to start making that donkey noise when he gets the message from me today.

                      I have this information from mate of mine he said go round third party house as long he does not have a rottweiler dog, and speak to him like a baby and ask him if it?s ok to resolve the matter in private.

                      If all fails ask him for name and address of his insurance company and go from there.

                        If he doesn't cough up ther info,,just tell him you're going to the cops to make a report for him not having any insurance.

                        If he doesn't,can your mate claim from that fund I was talking about in another thread,uninsured motorists bureau,or something,and claim from that ?
