Need Advice Terms and Condition contract gym company refused to return money.

    Hi need your help

My friend joined gym and paid ?200 cash for 6 months, he is in the army and now he has been called to join the fellow mates on mission and he could be there for more then 6 months.

He talked to the manager at the gym but they said they would have return the money if he had paid by credit card or by cheque.

I am shore all contract on terms and condition have a time limit to cancel, they gave him the terms and condition copy and no indication of time limit to cancel, since he signed the contract it has been 4 days only.

What should he do to get his money back from those crooks?

As far as I'm aware all contracts have to have a 14 day cool off period.

During this 14 day period a contract can be cancelled.

he joined a gym 4 days ago and then like the next day he decided to join the army?
Tell him not to worry, with a thought process like that, he'll quit the army tomorrow and start going to the gym.

Thanks for your reply and help.

Should I tell him to write a letter to the company for the cancellation terms and condition copy?

oh he was already in the army was he? the army with their tough physical training and gym equipment thats free to use as they want the soldiers to be in peak physical condition? That army?

hes an idiot if he went and paid to use a gym.

On a side note, I like the way your and your mates failures to read terms and conditions make the other party "crooks"

I've got to agree with Shady. I'm not sure we're getting the full story here I'm afraid.

How did he pay his membership? Does he still pay ie is there a DD set up.? How long is his contract ?

14 days cooling off for any contract, terminate in writing and state you want reimbursing by same manner. If DD is set up cancel it.

If contract has no get out clause or 30 days notice to cancel ask your mate why he is so stupid to sign a contract whilst in the army

As to be fair most people who sign up do not stay in the same area throughout their career its pretty certain that at some point you will travel like when they want you too
