    Outstanding car HPI

This is a bit of a story. My father in law bought a little car for my son to go to and from uni, about 3 weeks ago. The car was bought from a close member of my wife's family. All was well the lad was chuffed to bits .Then my son got a letter from a well known finance company, basically saying that the car has outstanding finance and they remain tittle holders.Could my son please send any receipts and address of the previous owner.
With it being a close family member we never did a HPI check just a shake of the hand.So when this letter arrived it put us all in a an embarrassing situation. The phone calls were made to the previous owner, she came round and truly looked horrified and promptly rang the number on the letter, in front of me and the wife. The company basically said that there was outstanding finance when she bought the car 4years ago. To which she asked why she had no correspondents from them to which they could not answer. She then went home and brought a copy of the HPI check she did when she bought the car,It showed the car was clear.
So i did my own HPI check and low and behold it has come up clear?
Now the family member we got the car off are not short of a bob or two, so i have 100% confidence that they have not took any loans out against the car.I have rang the dvla and they could not make sense off it but said if i payed ?5 they would send me all the info on the car.To which i did.
Is this some sort of scam?I did notice that to ring the finance company it costs 13p a min and the phone number and address are different from the one on the web? .Tomorrow i intend to ring the number of the web and ask them whats going on.
Has any one else had anything like this happen to them?

I had a log book loan thing on car that has a bill of sale and they can take it off your front even smash windows so i flogged it

HP is a different beast altogether

If you buy a car and they do not tell you it had HPI owing or deny it when you ask, the finance company have no claim on car. Tell them take it up with the original owner you bought in good faith

Citizens Advice - The car you bought is still on hire purchase

btw this has changed slightly since i last looked for similar it was more definite but the gyst is the same "good faith"

I cant quiet get my head round it.But i have just been emailed an original bill of sale, between the two previous owners and on it it state that there is no HPI ,and he is the legal owner with the right to sale ,signed with his address on it.To add insult to injury i have just paid ?1600 insurance out for the car.

I dont think they have a leg to stand on those receipts show car bought in good faith, you also have the v5, the car is yours

As long as its not stolen or has a log book loan on it there is little they can do but take you to court and lose, if there is any finance on the car its between them and the person who took out the loan

Some companies guarantee the HPI check so if it comes up clear then later on you find out it's not they pick up the tab.

Just rang the finance company and they said that there still is outstanding HPI. If i send them proof that i bought the car in good faith and i did not know about any outstanding API along with the old receipt they will release title on the car to my son.
