    Train fine

    Hi, My son just got a fine in the post of ?20 for not having a ticket on a train.

    It seems someone has given them his name and address as he was no where near there at the time.

    He sent the letter back saying it was not him but they are still asking for him to pay the fine.

    Any idea what he should do next?

    if the letter doesn't convince them? Do you know if there is cctv in the area were it is claimed he did not purchase the ticket?

      Thanks for the reply, The fine was for Swainley and Gravesend so I would think that cctv would be in at least 1 of those stations.

        I am sure they are supposed to take a pic of you now to prove it is you in case you dispute it.. I remember boasting about doing this in my early to years to a train ticket person and she told that they had started to carry cameras in our area in case this happens, this was about 10 years ago.. So surely they must still be doing this or maybe it depends on the train operator..

        Basically it wil not stand up in court and is easily contested, I am sure your son has an idea of where he actually was during the time and date in question.. its up to them to prove it was it was him if it is contested.

          1) data protection act - cctv has to be kept for 30 days - you (your son) should be alloud access to their cctv to view "him" committing the offense.

          2) Ask his (your son) mobile phone company if they can give a rough or exact location on <TIME/DATE>

          3) OFF TOPIC:

          Somebody got accused of something by the fuzz, (only a murder charge) but
          he (genuine) got away with it because he posted on facebook something
          isp was traced to his friends house that was xxxxxxx miles away at the time.
          (assuming his friend didn't use his a account)

          got to go, got a customer to beat up.

            They must know he did not make the journey, who the f**k would want to travel to Gravesend, never mind pay for the privilege. I would not only want a refund but compensation for being accused of going there

              Its called gravesend because thats where they sent dead bodies that had the plague (black death} You right been there once, no need too go again

                be wary of requesting CCTV footage, there is a minimum charge of ?10 for any footage released,
                it could be more if the CCTV controller has to start blurring out the faces of other passengers, it could end up costing you more than the ?20 they want,
                I would start by asking for proof it was your son, like, ID seen, photographs taken, copies of signatures.

                  Oh said the word on the street. In that case ask for a photo of 'your son' doing the job.

                    its not minimum charge its a ?10 charge and they CAN charge you this but not all do.

                        In this country you are innocent until proven guilty.. Where's the proof this happened.. I'd tell them to fcuk off and take me to court especially if it wasn't me

                          i agrre tell them to sod off and prove that your son was on the train, i believe its called hearsay what they are using, a court would throw it out also how the hell do they no that he didnt have a ticket hearsay again

                              Make up an invoice and send them a bill for wasting your valuable time. we need to stand up to these people or in another 20 years it will be pay and ask no questions. good on you for not taking it.
