    Any legal people in da house?

    As some of you may be aware I got pulled for driving with no insurance because the now ex wife cancelled the direct debit and didn't think it was wise to tell me especially as I work away for 4/5 weeks at a time so don't see any letters or bank statements as I work the other end of the country.

    Anyways I sent off the payment slip ( with debit card details ) for the ?200 fine back in November. Anyways I've just received court letters as apparently I haven't paid the fine, but on the court papers it has the wrong vehicle details in the court papers and on the policemans slip, only thing is I signed the slip at the side of the road without looking at it.

    Any chance I could get off with this?

    Not a legal eagle but, generally the cops must to have everything spot on or it gets thrown out. Even though you signed the slip, I would imagine. Did your card get debited ?.

      I haven't been able to check my bank for that yet as I'm still away so don't see statements, I'll go to the bank first thing Monday to find out though

            Mototing law is defo not my speciality but you have a chance of getting off with it. Although your side of the documentation has to be spot on.

            I would honestly say, post in that forum, but discuss this with a specialist solicitor, contact the law society for someone in that area of specialism and it could be the best ?!00 you will spend.

              If the evidence is incorrect get a solicitor to play this as your trump card, do not in any way let the CPS know there is a mistake, and if you go to court play this trump card as neglience in regards to the procecuting officer, any decent magistrate or judge should throw it out of court because it is a mistake, and in their eyes they don't make them.....

                        in my experience, and i have got off 2 speeding tickets in court

                        everything must be perfect, any discrepencies and the court clerk will suggest to the magies to end the case, end of. speak to a lawyer mate, you dont even need to pay for it, they could tell you what to write to the courts
