    What will happen if your vehicle doesn?t have insurance

    If a vehicle does not have insurance, the registered keeper of it could:
    ? receive a fixed penalty of ?100
    ? have their vehicle wheel-clamped, impounded, or destroyed
    ? face a court prosecution, with a possible maximum penalty of ?1000
    An Insurance Advisory Letter (IAL) will be sent to inform the registered keeper of a vehicle that appears to have no insurance. It advises the keeper what actions to take to avoid receiving a Fixed Penalty Notice.

    I had the pleasure of being stopped by the Police on a roadside check and getting done for having no insurance. I had my documents in the vehicle but it turned out the Insurance Company (Direct Line) had cancelled my policy as they say they never recieved a copy of my no claims. They had apparently sent me a letter by normal post (no requirement to send recorded) which I never recieved warning me they were canceling my policy. It is an Absolute Offence in law to have no insurance. This means if the Insurance company cancel your policy, even if you've paid your fees you are guilty in the eyes of the law. There is no defence allowed. It doesn't matter what you or your lawyer say you can still be charged.

    I was up in Court twice at the cost of 750 plus lost earnings and fortunately someone with sense decided it was not in the public interest to continue the case.

    On my first court appearance the Magistrate was going to let me walk until her brief informed her that in Law I was guilty and must be punished regardless of the circumstances. Fortunately she delayed the case to a later date where this bell end wasn't in attendance.

          i had this the same, but the insuer was think "Scumterm Dircet" they said they have to send letter by recorded post, then can only cut your insurancse off after 7 days.

          how long ago was this?

          that mid thing, tried to tax own car other week, "no insurancse - sod off"
          but mid said yes (it was)

            On my first court date I pleaded guilty as I'd been advised it was an Absolute Offence, but I put a mega sob story up about how I'd lose my licence if I got six points and even if I kept the licence no insurance company would touch me. I'd lose my business, house etc. I also had an Ex wife and Daughter that relied on my income to pay maintenance and if I wasn't working then there'd be no maintenance. They'd also lose their house etc.


            The Magistrate asked if I had saught legal advice and I informed her I couldn't afford it but knew it was Absolute. As I said she was going to let me walk on my sob story but the Clerk told her I had to get humped. Fortunately she pretty much ordered me to seek legal advice before she would continue the case.

            I spoke to a lawyer who for 750 told me I was guilty but to pleed not guilty next time and ask for a further delay whilst we saught records from the Insurance Company and he took the Procurator out for a meal. He said it was a delaying tactic as there is no requirement for the insurance company to send any letters recorded. It is my responsibility to ensure I was insured.

            I went back two months later and pleaded not guilty and asked for more time as advised. It was then delayed a further month. Two weeks later I got a leter through the post saying that as it was not in the public interest they were not proceeding with the case. Happy days, but it still cost me over 1000 in lost wages and fees.

            To make it worse I then Insured with CVD and two months later somene ran into me whilst I was parked. I phoned the help line to be told I wasn't insured. A couple of calls later it transpired I had paid the Broker and had my Certificate but the Broker hadn't forwarded payment to the Insurance Company. Luckily the Broker picked up the Bill but if there'd been fatalities, God or fictional character :-) knows what would have happened.
