    After years of speed cameras and penalties for ordinary motorists, ministers switch focus to aggressive boy racers


    Shake-up: Transport Secretary Philip Hammond said new laws will focus on 'serious and repeat offenders'

    Aggressive drivers are to face ?100 on-the-spot fines in the biggest shake-up of road safety law for decades.

    Transport Secretary Philip Hammond will today declare an end to the war on ordinary motorists who make honest mistakes.

    But ?boy racers? who tailgate, undertake or cut up other motorists, those driving under the influence of drink or drugs and repeat offenders will face tough new penalties.

    Tens of thousands who make minor transgressions will be spared points on their licence if they agree to undergo education courses to improve their driving.

    Mr Hammond said Labour?s obsession with speed cameras meant motorists caught driving a few miles over the speed limit were currently prosecuted, while ?idiots? who endangered lives get off ?scot-free?.

    The Government has scrapped grants for councils to put up new speed cameras, and installations have already slowed down, he said.


    Key measures to be unveiled today include:

    New fixed penalty notices of between ?80 and ?100 for careless driving, which currently has to be prosecuted in court.

    An end to the right to request blood tests rather than breath tests for drink-driving.


    A re-test for disqualified offenders before they regain their licence.


    Police station drug-testing and a possible new offence for drivers who drive under the influence of drugs.


    The seizure of vehicles belonging to the most dangerous offenders to keep them off the road.


    A post-test qualification for new drivers to encourage lower insurance premiums.


    Educational courses offered in place of points on a licence for minor offences.



    Mr Hammond confirmed the Government was also considering raising the speed limit on motorways to 80mph, though he said no assessment had yet been done of the risks and benefits.

    He said the Government?s new road safety strategy marked a ?clear break? with Labour?s approach since 1997.

    ?We want to make a clear distinction between those drivers who are a real danger to road safety ? reckless, dangerous drivers ? and those who are merely occasionally careless or who make an honest mistake,? he added.

    ?That means much more emphasis on enforcement against those who represent the biggest risk and a big increase in the use of education for those who make minor transgressions.

    ?The big problem under the last government was using technology.

    Speed cameras were installed and speed became the only focus of the road safety agenda. It ceased to be a road safety agenda and became a speed agenda.

    'That meant somebody driving at 55mph in a 50mph limit might get prosecuted but the idiot who is weaving in and out of traffic and tail-gating gets off scot-free.?


    Mr Hammond also confirmed the Goverment are considering raising the speed limit on motorways to 80mph

    The number of convictions for the offence of careless driving, Mr Hammond said, fell from 125,000 in 1985 to 28,000 in 2006.

    Police were increasingly discouraged from pursuing careless driving prosecutions because the courts were ?clogged up?.

    ?So we are going to introduce a fixed penalty for careless driving ? something we don?t have at the moment,? he said. They will be issued by police on the spot, but could also be sent to motorists spotted on roadside cameras.

    Like speeding fines, the notices will attract three points.

    Minor offenders will be invited to avoid points on their licence by going on a driver education course.

    ?Serious and repeat offenders are who we want to focus on because they are disproportionately responsible for accidents, deaths and injuries,? Mr Hammond said.

    ?There will be mandatory retraining for offenders before they get their licence back.?

    On drink-driving, he said loopholes were allowing offenders to escape justice.

    Those who are 40 per cent over the limit are able to demand a blood test but because that has to be carried out by a doctor there is usually a delay. Mr Hammond said: ?Alcohol can then clear the body.

    People are playing that loophole so we are going to close it ? no more right to ask for a blood-test.?

    There will also be a crackdown on drug-driving with the possibility of a new offence.

    Currently, police have to prove both the presence of drugs and that a driver is dangerously impaired ? meaning prosecutions are almost non-existent.

    Mr Hammond conceded forces that have reduced the numbers of traffic police might have to rethink their priorities in light of the crackdown.

    ?Chief constables will decide on how officers are deployed,? he said.

    The moves come as an RAC report reveals that young people are 17 times more likely to be killed on the roads than with a weapon.

    Road accidents are the biggest killer of young people aged 15 to 24 other than illness it says.

        This Subject Infuriates Me

        Once again another Polise Money Box opens and needs filling but not from Burglary, Robbery, Murder etc NO the everyday motorist who already pays over the odds to use the roads.

        My blood boils when they use cyclist head cams to show drivers standards of driving for these reports, yet everyday cyclists ride on public roads, unlicenced, untaxed, uninsured and un tested, break the law quite openly by undertaking, tailgating jumping red lights, the list is endless, all of these are offences that the new system will punish the Motorist for commiting with an on the spot fine between ?80 and ?100 accordingly.

        As for motorway driving, surely it is less dangerous to undertake a middle lane hogger than it is to have to change lane FOUR times to pass an idiot who is hogging the middle lane, if done with caution. For the LGV drivers this is even more infuriating and as they are unable to use the outside lane, yes you guessed it they have to move out into the middle lane and then be fined for tailgating or undertake the middle lane hogger, both of which are deemed illegal.

        It's just a piss take to flout money off the motorist for whatever the police concider to be in there eyes at that moment in time to be classed as an offence under the new regulation.

        As more people on the roads these days now use Motorways then it is about time New Drivers had to drive for twelve months without being allowed on motorways and then take a motorway course to teach them how to drive at high speed and deal with the hazards of motorway driving.

        Some boy racers are bad enough on the normal roads without using motorways and possible new maximum speed limit of 80mph.

        These are only my views as an Ex Driving Instructor, LGV Driver and Motorist for 35 years including Cycles, Motorcycles and Cars.

          As SOB said what am I supposed to do when an idiot is hogging the middle lane on a motorway or hogging the right lane on a dual carrigeway becasue she/he wants to turn right after 5 miles? The only way to overtake if from left. The government needs money and easy target are motorists, we Brits always taken for granted by stupid governments. In France the government think many times before trying to take any money from people, why? The French are brave and they will give their government very hard time if it tries to milk them.

            I frequently use the motorways late at night and this is my biggest bugbear. Will they prosecute the idiots who sit in the middle lane or right hand lane ?? They have expanded sections of the M25 to 4 lanes, yet see see lane 1 hardly used.

            From what I have read, France and a lot of the socialist European countries are going to be facing some big financial problems in years to come.

                I really can't see how this is going to work. I often undertake on a 3 lane section of road. Lane 1 is a glorified slip road while lanes 2 & 3 are a busy A road. Lane one is clear while lane 2 has a ~~~~wit doing 50mph.... I fly past doing at least 70mph in lane 1, I never join the A road.
                With these new laws I could be done on the spot. But what if I contest the officers judgement? Can it still be taken to court? You cannot pass a law that refuses the accused a right to defend themselves in a court of law. So loads of people will contest the tickets/fines, clogging up the courts.

                What will the the definition of tailgating be? Given that speed & distance will have a huge role to play it deciding what is an offense.

                I tailgate, when you get morons in lane 3 doing 60mph & not moving over to the gap in lane 2. My usual trick is to continue doing my normal 80-90mph until I'm within shouting distance. It works. Audi's, merc's & BMW's all get out of my way. You also get to see the startled look on the faces of drivers who don't check their mirrors regulary.

                If the government spent money on educational adverts showing drivers how to merge in turn & change lanes safely we wouldn't need all these ridiculous laws & cameras.

                Even just changing lane 3 to a minimum speed limit of 70mph would solve loads of problems.

                  as someone who has only been driving 2 yrs i gotta say there are a lot of ~~~~in nutters on the road. i didnt realise so many cars indicators didnt work when joining a road (personally if they dont have the manners to indicate i dont have the manners to let them in), at a roundabout (doh im not mystic meg and know what exit you are using).


                  sorry canker but is 90mph not against the law??

                  as ive said before its astonishing someone can pass a driving test at 17 and thats them for life when every 10 yrs we need to get a new passport to go on holiday??

                    Lainie, it's only against the law if you get caught & can't justify your actions.

                    On a dry, clear road, with good visibility you can get away with a telling off. But you have to show you were aware of everything.

                    In the real world traffic cops are usually only interested in those going over 90mph. Or driving in a recless manor.

                    Passed my test when I was 17, now 20 years later, I'm amazed I've survived. In any single journey I can witness the following...

                    Failing to indicate when joining a road or changing lanes
                    Crossing the solid white line at red lights
                    Drifting across the road (when on a carrageway)
                    Drifting over lanes (when on roundabouts)
                    Trying to force their way into the correct lane
                    Failing to accelerate until matching traffic when joining busy roads
                    Not using mirrors at any point during a journey (at least while I can see them)

                    The list could go on for a long time.

                    Two of my personal pet hates are those that try to muscle into the correct lane (wasted on me, I never surrender my space on the road). And the 'window kissers', these are predominately female... with the occasional male (who I suspect are gay). Their seat is so far forward their chins are almost touching the top of the steering wheel. This puts them in a position where they cannot see into any of their mirrors...Which is why they make me nervous. If you can't see anything behind you then you obviously don't consider them a threat to your safety... so why would you indicate since you only care about what's in front of you?

                    I'll stop the rant, people could get hurt.
