    Conviction for downloading music

    Seen this before on Sly News...

    Scary stuff... Is the law different in Scotland than England with regards to this?

    Scary stuff. Especially considering the vast majority of the files were karaoke tracks!

    I'll be the first to say it: Should the police not be dedicating resources to catching paedophiles?

      Yeah -- its hardly crime of the century. I bet a lot of taxpayers money went on that...

      Thinking about that shouldn't the police focus taxpayers money where we want it to targeted.

        They were obviously making an example of this poor woman, hoping to deter filesharers. Having your home raided by Police and 3 years probation is a heavy price to pay for such a trivial offence.

        Edit: Some more info: The investigation began in 2008, by investigator from two record industry bodies, The British Phonographic Industry (BPI) and the International Federation for the Phonographic Industry (IFPI). They made a complaint to the police who searched her house.

              They didn't post any background to the case, I am pretty certain the police didn't just turn up one day. I am sure there i will have been plenty of communication with her to begin with.

                Not really how police raids work mate. What would be the point of raiding her house if she had already been wired off?

                  Downloading and file sharing are 2 different things.

                  Downloading to my knowledge is not illegal, file sharing is as you are providing someones intellectual property with other people without providing payment to the copyright holder.

                  A quote from a legal website:

                  As UK law currently stands, an individual shall be criminally liable 'for making or dealing with infringing articles' by virtue of section 107 of the Copyright, Designs and Patents Act 1988. In practice however, the enforcement of copyright is primarily a civil right which is enforced on an individual level. As such, little use tends to be made of these criminal sanctions.

                  So I believe she was guilty of delaing with copyright material.

                  I believe the days of the "free" stuff will soon be coming to an end, so make the most of it!

                    I stand slightly corrected with this quote:

Stern letters have been sent which issue threats of disconnection if the file sharing is not discontinued. The BPI has even threatened file-sharers with a court appearance.

                      You will also find that it's the monetary amount that made this case.

                      If you have downloads that if bought would cost a few hundred pounds, they are unlikely to do anything other than send out letters.

                      But the value of the downloads, due to the vast amount of files, is what made this an example. The previously stated amount fined for 24 tracks was from the US, where the nob-jockies that make money from hunting file-sharers have more power.

                        I would not think that court is going to grant an order for music sharing unless there has been attempts to resolve the issue directly with the user first.

                          OK, so say you see something here on DK, but automotive software is not alloud, you mention it, then you get a PM with a link to an inferior website.

                          You join that website with a 'fictious' user name (incase DK Admin are out looking for members who dessert DK) - you find the only way is to join and download the torrent, get the file, shut programme down!

                          Yet before, you could just cut and paste the RS links!
