    Film-makers seek injunction to block pirate site

    Film-makers are going to court in a bid to block access to a site that hosts pirated versions of popular movies.

    In a UK legal first, the Motion Picture Association (MPA) has applied for an injunction forcing BT to cut off access for its customers to Newzbin.

    The MPA, the industry body for a number of movie studios, said it was targeting BT first as the largest internet service provider in the UK.

    BT confirmed it would be in court later but did not make any further comment.

    The MPA wants BT to block Newzbin with the same system that stops access to sites hosting child sex abuse images.

    The members-only website aggregates a large amount of the illegally copied material found on Usenet discussion forums.

    The MPA is the international arm of the Motion Picture Association of America - the industry body representing movie studios such as Warner, Sony, Fox, Disney and Paramount.

    It brought its action against BT because, as well as being the largest ISP in the UK with more than 5.6 million customers, BT supplies the site-blocking system known as Cleanfeed to many other big UK ISPs.

    Success in the courts may mean the blocking spreads to those other operators.

    The MPA began its legal action against UK-operated Newzbin in 2010, which resulted in the High Court telling the site to remove material it hosted that infringed copyright.

    This action was taken quite a while ago. The Newzbin guys already have measures in place to circumvent the block.

      'Pirate' link site stands defiant

      A website which offers links to pirated movies has threatened to 'break' BT's internet filtering system if the company tries to block it.

      The Motion Picture Association has applied for an injunction that would compel BT to stop its UK customers accessing Newzbin 2.

      A High Court ruling on the case is expected on Thursday and may pave the way for further website blocking.

      The BBC spoke to one of Newzbin 2's administrators ahead of the verdict.

      He did not expect the judge to find in the website's favour.

      "In most legal systems the verdict goes to the man with the biggest pile of gold," said Mr White, who represents the website but did not wish to disclose his real identity.

        Whats the point if they block that site all that will happen is that another site will pop up then they will go through the same rigmaroll all over again and again. Look at the pirate bay its still going strong and they have tried everything to shut it down.

            This is more than likely the begining.Who knows what next, target other indexing site or other ISP to block out sites.

            They will more than likely never block usenet this way so really this opens the issue of net censorship

                Pointless !

                Courts should really know better than to try censorship of a medium that is effectively uncensorable. Proxies/VPN's mean that ISP's are effectively nothing more than service providers and no longer have the ability to block any site that their customers require to visit !

                  Newzbin is just one of many indexing sites. A lot of money spent to deal a pretty minor blow to piracy and considering Giganews offer SSL and a VPN with their Diamond accounts, its quite easy to circumvent the block.

                    The ruling is in, BT must block this site! Good Luck with that.


                    In a UK legal first a judge has ruled that a website offering links to free movies must be blocked.

                        So whats next for bt- A discrimination case. Why have they been tergeted to block certain sites while vermin sky and all the others can continue to offer access. If i was bt i would take this to highest courts in the land.

                          I think the consensus was that this was the test case. Now its won the MPA will no doubt take the rest of the UK ISP's to court and request the same blocking.

                            BT's head of retail Simon Milner came out swinging after the legal setback over web-blocking. While admitting the company is "not deliriously happy", it welcomes a clarification. And BT won't be appealing the decision.

                            "We believe in an open internet ? we won't do any other blocking," he told us. "We will never stop our customers getting to any service they want to get to.

                            "Unless a court orders us to."

                            Although the case went against BT, Milner points out that a test case has finally made the law clear. And since web-blocking requires a court order, he says BT is satisfied with that. Each web-blocking request will have to go before a court ? where a judge must examine it on its merits.

                            "There's no suggestion in this judgement that BT has done anything wrong as an innocent intermediary. We said it's questionable whether an intermediary can have these obligations put on it. Now we know.
