What sky can't buy is rights to a full satellite, What leaves me assuming if sky buy up the rights, A company could buy rights from the premier league and start up a broadcasting system on a satellite, example 19.2E, There is nothing stopping them, Just like nova greece operates on 13.0E with Sky Italy and there is F all sky can do!

In my eyes, If tring can do it on 16E, So can anyone, No one will stop it in my personal opinion!

    Regards.

If i remember correctly when this started nova had stipulated that their cards can only be used in Greece just like sky cards can only be used in Uk.So just because she was able to get a card via a supplier does not mean nova knew about it.All that sky and others have to do is clamp down on dodgy suppliers and highlight their t&c more.
One day there will come a provider that has pan European rights and supply their cards to all countries, just not today.

Of course the prem can sell to who they wish, but lets face it, who really controls the prem.

Very interesting to see how this will play out.

Excuse my ignorance, but what decoder+card would you need to do what she did?? did she buy the equipment in the UK?

Again...sorry for what is probably a very n00b question on this forum

              SETFIRETO RAIN.

Yes, anyone could buy the rights and broadcast from 13'e like NOVA, but would the prem league sell the rights to them???

Are you telling me the prem and SKY do not work hand in hand to a massive degree?????

If pan european rights are the future, sky are gonna get first dibs, and at what cost to us????

The European rights i suspect would go to the big boys like sky and yes they will make sure they get their money back and more.
It may be controlled in part by some commission or other to ensure fairness in price ,but at the end of the day money talks.

Now that would mean if skyuk tell you that their card must be solely for purpose in the UK but is used outside the uk, then you would break their T&Cs thus cancelling the card but you would possibly be exempt from prosecution unlike before.

Just like card sharing is not an illegal act but using a sky card in a 3rd party receiver is not illegal but it breaks skys t&cs.

So if any provider wants the rights at a cost then they can or could be instructed to amend their t&cs
It won't make a difference what T&C's are amended to, if they break statutory rights under EU law, they can't be enforced.

If this stands as it is & it's upheld that an individual or company can purchase services from another EU broadcaster. The only thing I can see happening is the FA having to change the contracts to all those effected by the open market.

Sky might get a reduction in fees, that they won't pass on to the customers.

but this is the killer bit

" The ECJ said the transmission in a pub is a "communication to the public", which means that without the permission of the FA Premier League Murphy is in breach of the copyright directive. This directive would not stop individuals buying foreign decoder cards for domestic use."

means its ok for private but then the broadcasters can stipulate card holder must be in country of issue and that knocks it stone dead or almost.

What your forgetting is, its their card. They card merely allows you to view prem games but they can dictate how the card is to be used.

                          Thats their right.

Do you think that this ruling will allow people in Spain and the likes to buy and use a sky uk card ?

The ECJ stated about the fact that the game was not there " intellectual creation " there for they don't hold rights, Yet they do hold rights to such things as the premier league theme song, Its ridiculous if you ask me!

As I said in the other thread!!

The British court referred it to Europe for their opinion, the advocate general's opinion is that the prem are wrong on this. Now it will go back to court.

And careful what you wish for as I can see Sky buying all Europe rights and distributing it as they see fit, and could well mean no 3pm showings anywhere in Europe.
