A BOY of 14 caught with two guns and live ammunition walked free yesterday ? as a judge said Parliament had "tied his hands".
The schoolboy escaped being locked up because in the eyes of the law he cannot be classed a "dangerous" offender.
Sentencing guidelines meant the judge had to let him off with a youth rehabilitation order ? despite him admitting having two pistols and 13 bullets hidden under floorboards at his home.
Judge Roger Chapple told the boy: "The courts generally take a very serious view of this sort of thing and mark it with long prison sentences.
"As it is, Parliament has tied my hands. I have no power to send you to any form of detention."
If the boy had been 16 or over he would have been locked up for a minimum of three years.
But the judge said at Inner London Crown Court that in legal terms it was "impossible to come to the conclusion" he was a danger.
The boy was found with a Russian military Tokarev TT-33, a Mini GAP and the ammo at his house in Manor Park, East London. He admitted two firearms-related offences and was sentenced to a three-year rehab programme.
The judge said: "Guns kill people, that is what they are intended for."
James Burley, defending, said the teenager had been "somewhat used" by other people.
The Ministry of Justice said last night that sentencing guidelines are set by an independent body and that the boy had not been found guilty of intending to use the guns.
