Bank error in his favour but court says pay it back

An unemployed Greenlander who suddenly found himself a krone millionaire thanks to a bank error and began giving away the cash was ordered to pay it back by the Danish supreme court.

Angut Kleist, nicknamed "Greenland's Robin Hood" by the media, was also sentenced to 100 hours community service after the court ruled Friday that he was not a crook but had succumbed to temptation.

Kleist found in 2008 that his account had mistakenly been credited with 1,335,370 krone (180,000 euros) and hastened to spend it, the Greenland newspaper Sermitsiaq reported Saturday.

Before the error was discovered Kleist had spent 421,500 krone, giving the windfall away to family, friends and even homeless people begging outside the supermarket in his village of Nanortalik in southern Greenland.

He claimed he thought that the money might have come from winnings on a German lottery but the supreme court ruled that he had no basis for this belief.

I personally could not understand how court made decision to pay the money back when this man is unemployed; after all it was the bank that made a mistake in the first place.

For example if you through a ship or goat to the bunch of lions who will be responsible for that mistake?

As the law stands (Uk law but Danish law will be similar), if you are given money or goods in error and were likely to of known that it was an error then you must pay it back as soon as possible. Usage of such money/goods is considered as theft (very similar to the 'theft by finding' laws).

For small amounts you'd likely get away with saying you didn't notice but for larger amounts you would need an extremely plausible explanation as to why you would think the money/goods were yours.

If you are on the receiving end of this type of banking error then attempting to spend and/or hide it is a waste of time. Chances are you'll end up having to pay it back !

Nigerian con are allowed to take the money from your account and court will just say you should check your money regularly.

Few years ago a new law to prevent money laundering and terrorist funding was introduced, why the bank computer did not ring the bell?

The law is blind and judges are corrupt if you ask me!!!!!!!!!!!!
