    Slate wiped for minor offenders



    Thousands of minor offenders will have their criminal records wiped clean as a major overhaul of legislation comes into force.

    Convictions resulting in a non-custodial sentence will be filtered from record checks after 11 years for adults and five and a half years for young offenders.

    Cautions will be filtered from record checks by the Disclosure and Barring Service (DBS), formerly known as the Criminal Records Bureau, after six years for adults and two years for young offenders.

    Serious violent and sexual offences, offences with a jail sentence and some other offences will remain on checks. A conviction will only be filtered if there is no other offence on the individual's record.

    The changes, announced by the Home Office in March, come after the Court of Appeal ruled that the law that requires people to disclose all previous convictions to certain employers breached human rights.

    The move will affect thousands of volunteers and workers who apply for jobs that require a DBS check each year including teachers, doctors, nurses and care home workers.

    It means that old and minor cautions and convictions will no longer appear on checks, which employers request for positions where the applicant will be working unsupervised with children and vulnerable adults. In 2011/12, more than four million people applied for a criminal records check.

      For example if every man and women are on criminal record, this country will come to a grind when no employer will want to employ criminals, this was designed to wipe your record to boast employment.

        If your serial then 11 years is a long time clean.

        I was a petty criminal until i was 19 then i changed after nearly going to jail and not been in any bother with police since.

        So IMO my record should be wiped


        but then again maybe im better at not getting caught and take less risks my spots have changed slightly

          But none of that stops your employer asking whether you have any convictions, at which point do you lie or not?

          It stops them checking via DBS. That doesn't mean to say that if they ask and you don't answer honestly that, if they find out later you had, that they couldn't dismiss you for lying. Although this would only really be the case if the employer can prove that your lie means that your employer cannot trust you. So if your non violent crime 11 years ago you stole ?30,000 but were never jailed for it, and your new job was as an auditor for a bank I think there'd be grounds to dismiss you - although I'm not a lawyer.......Banks would probably welcome you with open arms and probably ask you for tips

          Oh and just because someone has a clean record for 11 years doesn't mean they have done nothing, it could mean they haven't been caught - I don't think Jimmy had a criminal record.

                    I'm happy with my record being wiped of a minor indiscretion. I was employed at the time & it never effected that job. After 4 years I no longer had to declare it as it was classed as 'spent'. But it would still show on a CRB check.

                    It's also safe to say that everyone breaks the law several times a week, if they realise it or not. I speed regularly, but don't get caught for it. But it's hard for those bad eggs to keep their nose clean for so long.

                          I've rode several bikes without lights on, but they were so f'ing ugly...I'd lose my boner if I saw their faces!!

                          Thinking back on this, I have done so many things that would of got me into a load of trouble with the police. Some of it seemed like harmless fun at the time...now i know better. At times I've wondered how I got away with it all.
