Keir Starmer QC warned it was time for a "tough stance" against the perpetrators of benefit and tax credit fraud as he set out new guidelines for the Crown Prosecution Service (CPS).

The Director of Public Prosecutions said the ?1.9bn annual cost of the crime to the taxpayer should be at the "forefront of lawyers' minds" when considering whether a prosecution was in the public interest.

Suspects can now be charged under the Fraud Act, which carries a maximum sentence of 10 years in prison, the CPS said.

In the past, benefit cheats have often been pursued under specific social security legislation which carries a maximum term of seven years.

A financial threshold which prevented benefit fraud cases of less than ?20,000 from being sent to crown court will also be abolished, the CPS said.

Professionally planned frauds, the use of a false or stolen identity and cases involving attempts to dispose of the evidence will also be targeted.

Benefit fraud of less than ?20,000 was previously automatically allocated to magistrates courts, which can hand out maximum sentences of only 12 months.

The financial threshold will now be abolished, bringing the prosecution of benefit fraud in line with the prosecution of other fraud cases, the CPS said.

Last year, the CPS saw more than 8,600 prosecutions in benefit and tax credit cases, along with 4,000 in the first five months of this year, Mr Starmer said.

The current conviction rate is 89.7%, he added.

More BS everyone knows jail is a last resort you have to kill a person a day now for a week to get anything more than community service

Apparantly it costs over ?500 a week to send someone to jail, JSA is about ?72 a week

So lets say a man has a cash in hand job and gets ?30 a day for 5 days plus his ?72 a week and ?100 council tax and housing benefit a week

        ?500-?172 = ?328

Simple maths say country will be ?328 a week worse off, then when you factor that his benefit and cash in hand money will benefit traders and the economy as he will spend it and pay VAT then it will amount to more

Scare tactics they been regurgitating the same BS since i was a kid, its all designed to frighten people but the ones who do it serially know the law is toothless and if the get caught they will get a suspended sentence and have to pay it ?4 a week from their benefit what they are given anyway so in actual fact benefit pays for the original benefit fraud

so we just give them a slap on the wrist and let them away with it.

if caught frauding they should get NO benefit until the amount of fraud is repaid. that includes no housing or council tax benefit. that would punish them more than a cushty prison sentence. let them explain that to the kids " oh we are losing our house cause daddy is a greedy bassa that wants a wage and benefit at the same time.

i had to live with parents till i could afford my own place. pity thats not the case now as we wouldnt be in the bloody mess we are regarding housing benefit.

not saying its right Lainie but in little old england you cant just stop everything and let people starve to death, even if they stopped one benefit they would give them another hardship payment or food vouchers

oh im sure their family and friends can help out. you know the ones that do their housework, go their shopping, get their fags and booze cause they cant get out and can hardly walk. funny though when their money gets cut all these people disappear . maybe the wee fairy who stocks their cupboards with booze can help too as when reading the forms that must happen as the claimant is too anxious to go out etc.

same as single guy who cant work as he is in constant pain. on forms girlfriend does everything for him - washes him, reminds him of medication, does shopping, washing, ironing the list is endless. she of course lives at a different address (states we are NOT a couple) so 2 lots of benefits. then on next page girlfriend is pregnant. how did he manage that when in constant pain. they must think we button up the back

                  Its what makes Britain great

i like your real life insight it actually passes most people by, the posters on here who disagree with it all either dont really have a clue, and are genuine workers fell on hard times that have never seen or really been involved with welfare or they are trying it on themselves. Its human nature to get as much as you can be you an MP or a "benefit scrounger" no different in fiddling either and the same sanctions should apply for both

Anxiety, agoraphobia and bi-polar are now the bad backs of the 70's and 80's then throw in i am an alcoholic i cant work, all i can do is drink white lightning, and i am a drug addict its an easy route to an extra ?30 a week

You could always just put your unwanted population on a boat and send them to another country at the bottom of the planet. ( that is a joke if you don't get it )

I think we should just hang the b*****ds really. If you think about it, it would save a lot in the long run. Could always do away with trials and just have the angry mobs doing the job instead - it would be free after all. That what Dave's Big Society message is about isn't it?

believe me what i post is a tiny fraction of what i see every day in new job. its absolutely amazing what people put down on forms if they actually fill them in that is. most are too damn lazy to fill in the esa questionnaire properly. some just put name, address, dob and nino and their doctors details. then they kick off when their benefit stops. err you didnt put in the form that you had any questions with your health. then they say they are housebound etc. do people really think that they say they are in consant agony all day and cant walk that it doesnt get checked on!!

i will and have helped people on here fill out questionnaires if they are genuinely ill but please don't bleat to me about poor benefit claimants when i earn less than ?14000 working for the same people that pays their bloody benefit.

i get constantly ridiculed on this forum not only cause of my workplace but because im not too scared to stand up and say how wrong it is to get more money on benefit than those of us in work. i can hold my head high cause ive paid for everything i have with wages. believe me i have several medical conditions that would mean i shouldn't work but i do as i have my pride.

Aye but it's not the majority of cases where people are out to rip of the system, and even if it were there would still be people who genuinely need help to get back on their feet. Is it right to punish everyone because of the few? If that's the case we may as well burn Glasgow to the ground - it's has too many murderers. A bit extreme I know, but the few always **** it for the many genuine claimants. If they really want to do something then they should prove that those who are taking the pi$$ are taking the pi$$ and stop everything including any future pension.

from what i see gaston id say 30% at the most on esa are genuine. the majority that were on incapacity benefit had never worked in their lives. now they are being declared fit for work and are screaming "oh i dont get on with people", "i have anger issues" - well bloody sort it. they say no-one is helping me (thats not true) but more importantly as i would as why are you not helping yourself? as for jsa i know more working on the sly than not. its always the same the bad guys spoil it for the genuine ones. if people are genuinely ill they should have nothing to worry about. ive helped a few get into the support group but even then you will still be sent for another medical.

Just got to say that Lainie is at the blunt end and has to deal with those who you just know are trying in on and so it must be really galling when you know they do not deserve the benefits, unfortunately it is those who are defrauding the system that know what to claim for and kick up the biggest fuss when they don't get what they want and so those people are usually the ones going into the offices to complain. So it will be the likes of these people that Lainie will see and when she is working hard and having to put up with abuse from them yet they manage to claim more than Lainie earns it will harden your opinions.
I must also point out that Lainie is not just a "Benefits Claimants Basher" because despite what she sees on a daily basis she also realises that there are genuine cases out there and is prepared to help them !!!
I know that because I am one of those that she has given help and advice to and although I don't always agree with everything she has to say I have nothing but respect for this lady.
