    Man who failed to clear 19ft rubbish pile faces having assets seized



    A man who failed to clear up a towering pile of rubbish in the Black Country faces having his assets seized from him following a court ruling.

    Refuse Derived Fuel Ltd director Robert McNaughton served a term in jail early last year for failing to comply with a court order to clear the site in Moor Street in Brierley Hill.

    But the Environment Agency continues to struggle to get the 19ft high rubbish pile cleared.

    Now the agency has been granted a writ of sequestration from the High Court, allowing officials to seize assets from Mr McNaughton and the company.

    The assets would then be used to clear up the site.

    Harriet Templar-Vasey, spokesman for the agency, said: "We are continuing to take legal action to force Refuse Derived Fuel Limited and its director, Robert McNaughton, to clear the remaining waste from the site.

    "We have recently obtained a writ of sequestration from the High Court, which is a formal order allowing High Court Enforcement Officers to seize the assets of Mr McNaughton and the company.



    "Enforcement officers have visited both Mr McNaughton and the company, and are currently investigating what assets can be seized.
    "It is possible that there will be further court hearings in the near future as a result of this."

    The mountain of waste at the site once stood at 40ft high.

    It led to people around the site demanding a clear-up five years ago.

    Although some waste was then removed, the firm and Mr McNaughton failed to meet strict orders on the amount to go set by the High Court.

    He was sentenced to six months in prison last year.

          not sure EXCACT figers but there is landfill tax to pay.

          as for not sticking to permit, there was a case in m/c where you needed a permit to street vend, clause was "vacate your location evey 1/2 hr" fine if ice cream van, but in middle of high street selling cotton candy from a bicycle no good.


          So a bit more info is required, or listen so a weatus song cover of erasures, little respect

            Ya I would have thought where is the money spend paying for council tax, different rates for business company shouldn’t council give him a leg to clear the shite???

                Not a chance, the company only has assets of ?4,172 according to companies house.... and here goes...... ready? "It's load of old rubbish if you ask me"

                    I just surfed the 'net until I found it, as I usually do. Perhaps it's the terms you are using to search? I think I may have found his linkedin profile, not sure.

                    TBH it's the people near the place that I feel sorry for. So at the end of the day the environment agency have left it festering, and when they find the company assets are probably the pile of rubbish so recover ?0, the environment agency will have to pay to have it cleared anyway. If the environment agency had any thought they'd have cleaned it up, while chasing him for the cash, rather than leaving it to fester while they chase his company for assets it doesn't have and still end up paying. SO the real loser are the eople who live in the area.

                        He has many failed businesses behind him, as did the company secretary. Seems like starting and winding up businesses is a career for them, I can't comment that much really. Imagine waking up in your flat and looking out each morning at this on the opposite side of the road



                        Shouldn't have been allowed really, no idea what the council and environment agency were thinking. I know I'd be really p**sed off with it after 5 years of it being there.

                            funding the Waste and Resources Action Programme (WRAP), which gives advice and support to help businesses use raw materials, water and energy more efficiently
                            As meaty states in his own inevitable style its a big scrap car smelting plant cars into metal billets in essence.

                              there was a quarry that shut here in m/c nothing wrong, all safe, etc etc new machines, all thick people in hard bars and hi vis etc.


                              Accidentky license expired forgot to renew, ready to renew money in hand etc, got booted out, now just waste ground, where the fuss turn up WUTHIN 15 mins if you try to torch ANY stolen cars there.
