Disabled victims of the hated Bedroom Tax are to fight it in the Supreme Court.

Disabled Bedroom Tax victims to take their fight against the charge to the UK's top court

They are testing a ruling that the 14% benefit cut for having a spare room is unlawful for families with children but not for adults.

A campaign lawyer said: ?This is very positive.?

Charity Shelter said victims ?are in real distress?.

Many tenants have been forced to pay extra because they are unable to move to smaller properties.

A judge decided the cuts were unlawful on families with disabled kids who were unable to share a bedroom with another child because of their disabilities, but said the cut to benefits of disabled adults was justified.

group of disabled adults have now won permission to ask the Supreme Court to reconsider, arguing their case is the same as children?s.

John Gallagher, of housing charity Shelter, said: ?People with disabilities often need extra space for equipment or have homes which have been specially adapted to make their lives easier and those who fear losing their home are in real distress about what will happen to them.?

Ugo Hayter from law firm Leigh Day said: ?This is a very positive step as we are able to continue the fight on behalf of our clients against the bedroom tax.?

The Bedroom Tax, officially called the under occupancy charge, has affected around 660,000 people.

It means people of a working age in social housing who have a spare bedroom have found their housing benefit claims reduced by ?40 to ?80 a month.

They could win on legal issue, if they can say it only applies on council houses and not on the owner occupier houses…..I would have thought the disabled people were exempt from paying ???????? any way.

as someone who is classed as disabled and gets PIP I can tell you i would have to pay extra if I had an extra room as it stands, meaty not all disabled get a blue badge

I can't understand how this hasn't been removed yet! I mean We as a country are a member of the United Nations.. to which have said the bedroom tax is against human rights!

However, i believe something does need to be done about the housing shortage and benefits etc.. The conservatives have gone about this all wrong!

It could of been left to the councils themselves to politely ask people to move.. offering certain benefits to do so.. it could reduce the benefits bill and free up larger properties!
