    Spitting fines raise ?55,000: hundreds forced to pay up over 'deeply unpleasant' habit.



    Almost 700 people have been forced to pay out fines totalling tens of thousands of pounds for spitting in London?s streets, the Standard can reveal.

    Every London borough now has the power to fine people for spitting in public after Communities Secretary Eric Pickles last month agreed to a fixed ?80 penalty scheme drawn up by London Councils.

    Following a Freedom of Information request, it can be revealed that the three boroughs who have already introduced bans have fined 689 people up to ?55,120.

    Newham council was the first to ban spitting in April 2011, with its wardens issuing 634 fines.

    Waltham Forest council followed suit in February 2013, also using the Environmental Protection Act 1990 by categorising spit as ?litter?, to fine 42 people.

    Under by-laws introduced in November 2013, Enfield council has issued 14 fines - although one person managed to successfully challenge the fine in court.

    All of London?s 33 boroughs can now fine people ?80 for spitting after Mr Pickles rubber-stamped the penalties drawn up by London Councils? transport and environment committee.

    He had previously branded spitting a ?deeply anti-social and unpleasant practice.?

    The fine can be cut to ?50 if it is paid within 14 days.

    A spokesman for London Councils said: ?Anti-social spitting impacts people?s quality of life. This is exactly the sort of measure boroughs can and should implement to make their local areas more pleasant places to live and work.?

    Cllr Ian Corbett, mayor advisor for environment and leisure in Newham, said: ?Spitting is an unhygienic and anti-social act which our residents should not have to witness or walk through.

    ?We began issuing fines in response to complaints from residents and we consider that spitting is as disgusting as dropping litter or flytipping on our streets.

    ?By issuing these ?80 fines we are sending out a strong message that this horrible behaviour will not be tolerated in the borough.?

    It is up to town halls how to police and impose penalties, which could even apply to footballers spitting during games in public parks.

    People who spit in public are unlikely to be fined if they have a ?reasonable excuse? or if they do so into a handkerchief, tissue, bin, spittoon or other receptacle.

            Good pleased to hear it, can get all sorts of nasty dieseses from spitting.

            only EVER do it if got a gobfull of something nasty, unless SONETHING like gasoline diesel etc only do it 'out the way'

              I do have to ask though. The people giving out the 'fines' have no power of arrest, no power of detention, no power to compel you to give them your details..... so why would anyone give their details and accept a ticket of someone with no such rights? *shrug*

                  No mate im not for spitting,if I find the need to clear my head outdoors and I haven't got a hankie with me I will howk in the nearest gutter,its not the end of the world,i just think that the borough of London could make better use of its powers to get more important things done...

                    though they appear to be enforcing a council policy and invoicing people for ?80 rather than anything that is specifically against the law. More so when it's not PCSO's doing it.

                    It has been a long road to try and make spitting illegal.Other councils have applied to the secretary of state for a bylaw banning spitting or making it illegal.

                    But because their requests have been ongoing for more than three years and still have not come to fruition, Waltham Forest Council decided to use their own powers to fine people for littering and extend the littering offenses to include spitting.
                    Their powers are under the Environmental Protection Act 1990 Section 87 EPA that 'makes it an offence to throw down/drop or deposit litter and then leave it'.

                    A Waltham Forest Council spokesperson explained that there is no statutory definition of what 'litter' is, but it is commonly assumed to include materials associated with smoking, eating and drinking, improperly discarded and left by members of the public, or spilt and left during business operations and waste management operations.

                    This came into force in February and many people have already paid the fine of ?80.

                    This court case is the first time the council has prosecuted someone for not paying a fine for spitting.
                    So it wasn't the CPS, it must have been a private summons issued by a council and prosecuted by their lawyers. The point of the CPS is
                    The CPS prosecutes criminal cases investigated by the police in England and Wales
                    and in this case the CPS didn't, so that means the police didn't investigate the crime. I look forward to PCSO's invading football pitches when a footballer spits, since everyone is equal and the 'law' applies to everyone.

                    Forgot to ask, what if you're out for a walk with your dogs an it p*sses, do they take the name of the dog and invoice it?

                        However, what is the minimum age to fine?? What about drooling babies? Shouldn't they be punished for teething?

                              10, so if you have kids under 10 get them spitting while they have the chance, otherwise they'll be invoicing you *shrug*

                              i just think that the borough of London could make better use of its powers to get more important things done...
                              But other priorities won't raise invoices and income

                              I should add that people spitting need to be made to lick their own spit up off the ground. I'm just against so called 'laws' that are really just corporate policies being used as an excuse for making money.
