    Blackburn motorist with 38 points on her licence still driving



    AN EAST Lancashire motorist racked up 38 points on her licence but was still driving, new data has revealed.

    Figures obtained from the Driver & Vehicle Licensing Agency under a Freedom of Information Act request by the Institute of Advanced Motorists revealed that the woman, who is from Blackburn, had ten speeding offences against her for going too fast in a 30mph limit.

    The data revealed that some motorists had collected dozens of road-offence penalty points without even holding a licence.

    Another driver without a licence, a man from Stockport, clocked up 33 points. Another non-licence holder, a man from Leeds, had 28 points.

    There are more than 60 offences that can result in penalty points being put on a driving licence.

    They range from speeding offences, failing to comply with traffic lights or signs, driving with defective eyesight, racing, driving with drink or drugs in the system and being involved in accidents.

    A driver?s licence is usually taken away if they accrue more than 12 points.

    Blackburn MP Jack Straw called for an inquiry to find out how the Blackburn woman could still be driving.

    He said: ?It is amazing and I do not understand how she could have got away with having three times the maximum number of points and still be driving around. Somebody needs to investigate how she did that.?

    Burnley MP Gordon Birtwistle said: ?These people should be banned. I am concerned they are putting other road users in East Lancashire at risk.?

    Institute of Advanced Motorists? chief executive Sarah Sillars said: ?It has been three years since we raised this issue with the DVLA but we still have drivers on the road with multiple points allocated to them.

    Now we find that some of them have never held any kind of driving licence. We all have to share the road with these unqualified, uninsured and dangerous drivers.

    ?We need to punish offenders as well as give them an opportunity to change their ways. Offenders are unlikely to drive legally if they face a ban or points as soon as they pass their test.?

    Great, imagine this:-

    You have worked as a team leader in a pork pie factory for ten years, the road has always been 60 MPH, but you drive an E46 BMW, so your impatient and drive at 62 MPH.

    One day the local MP Mr Arnold Rimmer-Knobber decides to cut the speed limit to 50 MPH, your still programmed for 62 MPH, then the fuzz park a "mobile speed invoicing van" for a week, you only live up the road, so you leave at lunch, Becayse your unable to say as you don't speak polish.

    Clean license Monday, banned Friday, thank crunchie.

      Some thing does not add up, how do you accrue points on a license if you are a 'none licence holder'?
      Police have turned a blind eye to wrongdoings for years, so did in the case of Jimmy Savile, law and order don’t make me laugh!!!!

        Something to do with name xxxxx is the magistrate in the case and its mrs xxxxx the driver !!

        Also if you do not hold a license you can have as many points as you want until your able to drive, so if you get 12 points (banned) it takes what 5 years to come off licence for dangerous driving so banned then if they give you further 4 points 3 years into it then your ban extends! so it just carries on until basically you get jail for along time and dont drive get out with no points then you can pass test!!
        simple, get done for dangerous driving and section 18 and get 7.5 years imprisonment get out, then your able drive with clean driving license.
        Eitherway goverment earn money! Send you to jail then tax payer pays to keep you in for years (H.M.P. recover money from taxpayer) at EXTREME amount of money even when prisoners get about ?1.25 for food per day, or pay fine when they give community service aswell, then if not do community service then got to jail then get out and still have to pay fine, then cant afford to pay fine go jail then H.M.P. claims for keeping you there then release then still have to pay fine!! ADD up the sums!! ALL money, Quite simple, even private sector jails put even more exspenses in then charge the goverment then taxpayer pays!! Come on!! Think of the bigger picture!!! easy!!!!!!!

          MONEY, MONEY, MONEY!!!!!! ALL boils down to who you know, money, and secrets!! Like i wont tell your customer you really removed his dtc for the fault you couldnt be arsed looking for LOL, only jokin!!!!

            Since speeding invoices are designed with revenue in mind it's about time that they got a bit more real anyway and only handed out points in cases where the driver/rider is say 20% over the limit, though still invoiced for anyone breaking the speed limit as they do now. That way those who very occasionally stray over the speed limit while watching the road rather than the speedo would pay the invoice without points leaving those who really are nutters getting the points as well as the invoice. Cut down on court time and paperwork leaving the government to make more money from the invoices they issue.

            As for having too many points and still driving, that is generally the process that is followed. Back when I were a young lad we had endorsements and if you got more than 3 you were banned. However there were some 'loopholes' to that, e.g.

            Had 2 endorsements.
            Got caught speeding on 1st April
            Got caught speeding on 2nd April

            Now that would normally give you 4 endorsements, banned under totting up. However

            If you could get the 2nd April one heard before the 1st April one the court hearing the 1st April one couldn't take into account the endorsement received for the 2nd April one, so couldn't ban you from driving - even though you'd have 4 endoresements. Not sure if it's the same now with points, but yes the above happened to me, as I said a very long time ago It's a procedural thing.

            Just to add, and from memory, if you got 2 on the same day then it only counted as 1 for totting up.

              If you drive through more than one speed invoice cameras, if you didn't stop its classed as one invoice, if you stopped your journey then its a second invoice
