
One for the road? Not in Scotland: two drivers have fallen foul of the country's strict drink driving laws and been handed a fine and driving ban after each consuming just one pint of alcohol.
The low level of alcohol in their blood would have put them on or under the legal limit in England, however since December 2014Scotland has had a far lower tolerance aimed at cutting drink drive related accidents.
The difference means that drivers can be within the law on one side of the border but risk prosecution and a criminal record on the other.
The two drivers both from the south west of Scotland, lived a short distance from the border with England. Donald McCallie, 66, was stopped with a reading of 35mg per 100ml of breath while Ashley Medicks, 62, had a reading of 32mg. The legal limit in England is 35mg, in Scotland it is 22mg.
Both drivers were fined ?450 and banned from driving for one year despite McCallie's solicitor arguing that if he had been just 10 miles down the road in England he would not have been committing an offence. After the sentencing, Sheriff Scott Pattison said: ?That?s the lesson in Scotland. Just one drink can put you over, it?s as tight as that.?
