You certainly would, unless the phones contractual period has expired. If this is the case then get EE to unlock it for a small fee. If the contracts still running you're in bother unless you want to pay around a hundred quid for the unlock.

Mate you say jailbreak it, but in your initial post you say unlock it.
There's a big difference between the two. Unlocking the device means that you open up its cellular capabilities. Ie it could be locked to an O2 SIM card but after unlocking it you could use any SIM card in the device.
Jail breaking is a small change to the iOS operating system which allows third party apps and tweaks to be installed onto the device which are not approved by Apple.
Just for clarity are you asking about unlocking your device or jail breaking the device?.
