iPod touch Gen 5 64Gb Activation locked

Hi just purchased used iPod touch gen 5 64gb. I never noticed its activation locked until I got home I assumed it had a factory reset. The old owner can't remember what details it was registered with because it was given to her son as a gift.
can I get it activated . I know its running IOS 9.3.5

any help before I return it
