You need to be careful.... Some of the new jailbreak software won't handle your old firmware. Choose your jailbreaking software carefully. If you choose to upgrade be careful which firmware you choose as your iPod touch might not benefit from the newer firmware. Most new tweaks from Cydia and app store are geared towards 3.1.3 > 4.1 firmware.
