genuine wii fit plus wants to update a soft mod wii

downloaded wii fit plus but kept getting 002 error. so bought the original game for the missus for xmas. it wants to update the system. tried using wii back up loader, neo gamma ect ect and end up with 002 error. dont want to do update as dont know what system version it will update to or if the softmod will stop working,
any ideas.
wii is an early one that i have soft modded and is running system version 3.3e

what version of neogamma are you using??also what version of cIOS38 installer are you using?? rev14 or rev15.... if using latest neogamma 8-v15 wad with cios38 rev 15 i believe is not compatible so use cios38 rev 14 and are you using preloader?
