current cards clearly do not have a mode so the card can id the channel in the ECM stream. There is no SID in the ECM. only irdeto use CHID's in there encryption. so currently there isn't a way for NDS card to ID how many channels are being watched unlike Irdeto, only how many entitlements are in use.

Maybe this new NDS card once all the old cards are out of service they switch to a new ECM nano/mode, that can id the channel or how many differenct channels are being watched that only works on this new card.
So im im reading what you say right this could limit CS to a maximum of 2 shares due to all Sly HD boxes having dual tuners?

Maybe no SID's as such but the card can clearly identify individual channels from any particular ecm. Its fairly fundamental that any card is able to identify which channel its unlocking otherwise how could it control access ?

Sky will likely simply limit the number of different ecm's that can be decrypted in a particular time interval. Normally, a sky box would never decrypt more than 3 ecm's in a 10 second period (dual tuner box where your recording 2 and watching a third (which is on the same frequency as one of the other 2) ). They may want to add a bit more to allow for reasonable speed channel hopping - say limit to 10 ecm's in a 10 second period.

They may also implement multi pairing so each 'channel' has to have its own pairing sequence. Using that system it may be possible to limit the card to 3-4 concurrent ecm's, especially if they implement delayed pairing (so the card wil return 5-10 secs without pairing to allow for non paired channel hopping).
