Need some sound advice. To-day we decided to give virgin the heave ho, i phoned this morning wanting a disconnection of all services. They said that we had agreed to a further 12mth contract because they had increased our broadband from 10 to 20 mg ,that also seemed to include repayment of ?42 they owed us for a monthly ?2.25 a mth discount. Anyway this commanche wanted an agreement to pay them ?180.00 for the fact that we're cancelling a contract that was never agreed by the account holder. We ain't agreeing to this so then , how do we get rid of these people without agreeing to giving them free money. We intend contacting the consumer council, but these people will put this on the long finger in order to keep revenue comin in. We need to be rid of them by November 30TH. Any suggestion? If we did agree to accept these gangsters mugging us how little in direct debit payments would we get away with payin these people. THANKS IN ADVANCE FOR REPLIES.

An agreement is a piece of paper signed between the buyer and the seller.
Some companies will send you the agreement form to tick over the internet.
If you have done none of the above you have nothing to worry about!!!!!!!!!!!!!!
If you ever decide to cancel or do not want to pay, its your responsibility to go to your branch to cancel the direct debit.

So if i agree to go along (and stress i'm doin so under duress) with this nonsense of accepting a liability of ?180.00pfor cancelling a non existing contract, leave enough in the account to clear the monthly subscription then cancel direct debit? Found this little item, i seems to say that a contract can be oral. But the actual account holder the person who is responsible for this package has never spoke to anyone from vermin. All the contact calls were made by me and i've no recollection of agreeing to anything i don't have the right to agree to.I can't ask them for something that don't exist, They obviously gonna say its a verbal agreement but that has to be done by the account holder does it not.?Comment

Verbal agreement is not allowed in the court of law.
Ask them to see a copy of contract?????..stick to it.

I am fairly sure acceptance of service constitutes a contract.
The terms presumably would be discussed at the time of change of contract?
As for repayment I would think VM would acept a small monthly amount rather than pass the account to a debt collection agency, that's what we used to do when I worked for VM collections many moons ago!
I am struggling to think that Virgin would allow anyone other than the account holder to change details of the contract, a third party could of course if he/she said they were the account holder and were able to satisfy/answer the security questions asked etcComment

Can I assume that you give them 30 days prior notice either on the phone or in writing that you attended to leave them and that you wanted all your service's stopped.
You do know that your suppose to do this before cancelling anything with Virgin Media.
This happen to me, although I didn't want to cancel everything I only wanted to cancel the TV but at the same time upgrade my Broadband from 20mb to 30mb.
I called them up near the end of July of this year was put through to the relevant department but was told that because I'm still under the years contract agreement (which finished on the 21st of last month) they where not able to do this so they informed me to call up again near the end of August which I did, told them what I wanted and that I was giving the 30 Days notice of cancellation of TV service and got worked out that the new 30mb broadband installed and started on the same day 21st of last month that my old contract expired.
So I'm now under new contact with the Talk Unlimited Phone and 30MB Broadband for ?40.78 a month.
My latest e-bill has came through and can confirm that I'm no longer being charged for any TV service, in fact it's cheaper than it's suppose to be at ?37.00 not that I'm complaining.Comment

i've had this hassle with vermin after upgrade from 20-50 meg. i was also told i would have to pay cancellation fees as i had accepted new terms and conditions when upgrading my sub. i informed the customer service agent that i wasnt made aware of any new contract or changes in the terms and conditions, or i would never have upgraded. the customer service agent took my name number etc. and called me back 2 days later after listening to the recorded telephone call and hey presto i was in the clear with a nice cheque from vm for my month in advance that they also try and con you out of!!!!Comment

I gave them 30 days notice, that's how we found out about this crap they spewing. We have decided to go to sky. The Price is ?17.25p ( or there about's) for the first 6mths then ?22.25p a mth after that. That's 20mg plus evening wk end free calls. We plan on disputing this debt they've landed on us, but they in the meantime will have to chase after it. We bought a freesat box, skyplayer is already installed on the Xbox not to mention a HDD drive with tons of memory so there's no need to be handing these people money hand over fist. I also plan to use the savings to buy either a techno box or one of the other boxes that are out there, i hope i'll get the best advice when in deciding which to go for. Thanks guys for the advice and support you've given over the last few days you folks are really supportive and its been much appreciated. YOUR CHAMPIONS. THANKS

usually you will have to dispute the agreement by letter, but if the new contract was over the phone they should be able to provide the recording of it,
