As long as you're not lying you'll be ok. But don't believe your solicitor when he says it's an open and shut case because he can't possibly know at this stage. They always tell you it is so you instruct them to take the case on, as otherwise they won't get any money.
As it stands the flag is clearly defective, but that doesn't make the council liable. In order to establish liability the following questions will need to be asked:
Was the defect picked up on the last inspection?
If so have the council had a reasonable amount of time to repair it (i.e. a month)?
Is the street inspected often enough for its classification?
Was the street inspected on time?
Did anybody report the defect?
If so did the council have a reasonable amount of time to repair the defect?
Basically it's a question of timing. It clearly meets intervention levels, but until your solicitor gets the inspection records off the council he hasn't the slightest clue whether or not it is an open and shut case.Comment

Obviously not that good a job.
On a serious note, as has been advised get the history of the checks on the road and also any weather related issues. If the weathers been like it's been up here in civilisation the Council could have a get out clause. Also don't expect an answer next month. These cases can go on years.
