firstly give the seller a chance to refund you the money and then ask him to pursue damages from his courier... then give him a polite warning if he doesnt pay he will regret it.. if still no joy then get a few m8,s together and go to the sellers address and if he doesnt give you your refund take the ?770 out of his face... at least then you will have the satisfaction of him being in agony for a couple of weeks... these sellers/con-men need to realise that just because they are selling items at a distance doesnt mean there wont be consequences... there no better than theives in my book and should be treated accordingly... eg, prison or a good kicking!! regards mdt

Come on lads he is only asking for help and your expertise on the issue, the point is the bike has been delivered safely.

The question is how he either get the bike in good condition or how he will get his money back, paypal has washed his hands I can see?..

Always always use something with online tracking - golden rule when dealing with paypal/ebay!

Financial ombudsmen can't do anything about it as you haven't followed PayPal's T's & C's

Only way to get it back is to go to the guys house yourself!
The financial ombudsman are there to ensure that t&c's are reasonable. Why should paypals be more stringent than the Court of Law in the UK. I kept being quoted by PayPal that they are an online company that's why they need online tracking. What difference is there to that and a scanned copy of a signed for delivery note. It's nonsense. 1000's of goods each day must get delivered in this manner in the UK. Can you imagine disputing a delivery from Tescos online food department claiming there was no online tracking

          Good news.

As a gesture of goodwill Paypal are paying me back the ?770.00

I also told seller yesterday that if they did not pay me within 48 hours I would make a claim in the small claims court for the amount of ?770 plus costs.
