    legal advice needed please

    I'm going to keep this simple.

    My gf was stuck in traffic when a police car attempted to stop the vehicle in front of her. The vehicle then reversed in to her car causing damage to her vehicle.

    It then came to light the vehicle in front was from thrifty hire.

    Now this is where things get interesting thrifty insursncr have refused to pay out for damage to my gf car due to the fact the car was later reported as stolen.

    Now accident happened at 2.30pm on 13th of December and vehicle wasn't reported as stolen until 4.30pm also on the 13th of December.

    The thrifty car had no breaking entry damage and when found keys had been used.

    It is very obvious that car had not been stolen but person driving it didn't takeout the car in there own name hence reporting car as stolen after damaging both police patrol car and my gf car as the driver made a quick get away.


    Girlfriend has the police offers names and badge numbers as witness and also has registration of car.

    So who is liable. Thrifty have refused claim and my gf insurance said to fix hr car it will cost her the insurance excess plus she would loose her ncb.

        Just looked it up she's doesn't want to go to court as the criminal driving hired car is well known and could cause issues in future.She just wants car fixed after all what's the point of insurance if it tried to bend you over when claims like this happen.

            thrifty hire should be held responsible for not informing the police as car stolen and they do carry full comprehensive insurance to cover this sort of incident, get a good solicitor and send them a claim for car repair estimate and personal injuries compensation even its just a slight, you will win.

              you made sense there, was it your new years resolution

              If it were me I'd find the most expensive ambulance chaser possible on no win no fee and go get 'em. There's loads advertised all over the internet and they'd love to take on such a case, they'd make loads out of it. Serious, no win no fee, the accident claims ones. Thrifty will run a mile.

              Now is also a good time for your g/f to get a twinge in her neck m8 and see her doctor for whiplash, not forgetting all travel costs, care hire, phone costs etc while her car is off the road

                OFF TOPIC:-

                There's a guy here in M/C - i'll not mention his first name just his surname
                Mr Crettin - he basically lives on a corner and a stolen car went into his house took out the window and part of front room.

                He was in the Daily Meat headlines something like

                "Stolen car crashes into house"

                Basiclly Mr Crettin says "i can't afford to insure my house"

                Now i would like to point out

                1) There ALWAYS somebody stood at the door 'buying something'
                2) The windows has no drapes - all whitewashed!
                3) He has been in court SEVERAL times for fiddling the DWP
                4) He had a garage on the side of his house - he sold the land - now
                got two houses on it!
                5) Not get this - you expect like for like - window for a window, plaster
                for plaster - not Mr Crettin his window was replaced with a ROLLER SHUTTER door - all paid for some lowlife scum insuranse company!

                  I'm fairly certain that if someone stole my car & smashed up another car... My insurance would cover the costs, which would then be claimed back through the criminal compensation board.

                  It was thrifty's car that caused the damage. Hired out by them & only reported stole after the fact. They should be hung out to dry.

                        tough one that the no win no fee guys are interested in straight out cases tbh thats why its no win no fee

                        Now if somebody pinched your car and bumped someone caused no damage to your vehicle but damage to third party

                        and your car was recovered no damage all ok who would pay??

                        Your insurance covers yourself and any third party
                        involved in incident with yourself

                        The person who stole car is not insured to drive your vehicle.

                        All thrifty have to say is when we checked our vehicles before we closed we noticed one was missing and then reported it the time of report tbh if your car was stolen at midnight and you did not notice it until you went to work at 8am are you responsible for what happens inbetween of course not.

                        BUT

                        Thrifty hire have to take some responsiblity if car was stolen how was it stolen how did he have a key and drive away

                        Their end sounds like BS tbh but you have to find someone who will fight it for you it may cost a lot and may not get any results

                        If its not too much to get fixed maybe an estimate and a nice letter to thrifty threatening legal action in 10 days or whatever may suffice

                            so stictly speaking the person stole car from hire company using false name

                            Surely thrifty are liable then

                            If he used a false name he was not insured to drive their car.


                            Thrifty are guilty of neglicence imo as they should not allow a person to drive away a vehicle without checking his details


                            did he not show his photocard license and counterpart to get car or did he used forged?

                              Confused? read car at the seen of the accident with original car keys but the person who hired the vehicle denies driving, now this is the sticking point how can a car gets stolen with the original car keys in the ignition??

                              Criminal compensation not interested if it comes to pay because there are to many un answered questions.
