Hate too re-open this but now the wan ker is banging the wall in the early hours and has been doing it for last 5 days! I reported him too the council but wont do any good i think!

Buy yourself one of these little cameras. I have one for messing around with in the summer, attaching it to kites & my dog. It records in 720HD & the sound pickup is quite sensitive.

Use it to record noise levels then approach the old t*at the following day, recording everything that he does & say.

Once set up correctly the videos will all be time stamped. It's a lot better than keeping a diary. The police & council will have a hard time ignoring the problem when they see the footage.

Just remember to be nice & civil to him, he'll do all the ranting & threatening for you. The nicer you are, the worse he will become.

Sorry just skimmed this thread, so may have missed a few bits.

I know a bit about housing law, by all means pm me, but with this case you have done the right thing in first approaching the perpetrator. Log down all your attempts at talking sense to them (what you said - what they said).

Having a log of incidents including;-
* all the noise (times, dates, how it's effected your familys enjoyment of your home etc)
* all the occasions when you have asked your neighbour to stop etc
* all the occasions when incidents may have been witnessed by another party (a friend/relative visiting or another neighbour)
* all the occasions when you have contacted professional boddies re this Police, local authority etc.

Logs are not a waste of time. They are the first form of proof (and often the best) that you can present to professional bodies or ultimately in a court of law.

What's the tenure of your neighbours?

If private/owner occupier contact the local authority Environmental Heath department. Most local authorites have out of hours teams who can witness noise and approach perpetrators. They can give fines, install noise recording equipment and surveillance equipment (though you must supply your logs for this to happen), serve notices and ultimately take the perpetrators to court where they can gain court orders to confiscate noise making devices (TV, Stereo etc), not make certain noise within certain hours, fine etc. Serving an ASBO is also open to the local authority, but this is something that's normally done in conjunction with the Police.

Use your own surveillance equipment by all means, but be careful. There are laws around how you use it. Any cameras must be traced onto your address and not the public paths/highways or your neighbours address. If you are recording a conversation inform your neighbour you are doing so. Also evidence you may gain through your own surveillance equipment will probably inadmissable in court. Don't spend a lot - it may not be worth it!

If the tenure of your neighbours is with a private landlord, housing association or local authority it should be easier to get the matter resolved. Contact them along with the Councils Environmental Heath. I could go on for ever, so pm me if you need to know more.

Finally the threats made. Get them reported to the Police. Even if it's an OAP, get them reported and report them every time they threaten you - it will help your case.

camera is a great idea.

catch him on one of his rants, then post him a dvd of it.

he might alter his behaviour if he see's how unreasonable he is being......
