You need to read the terms and conditions methinks.
Doesn't matter if it is second hand or not, if it is buy it now then it is covered under distance selling regulations, buyer has 7 days to change their mind, sellers responsibility to pick it up etc etc. There is no way to get round the laws of the country no matter what you put in the description or no matter what eBay say, the law is the law end of story.Leave a comment:

if he paid by paypal he has 30 days(which have elapsed) to put in a dispute if it was by cheque or other means its up to you but to be honest he is like douglas barder,he hasnt got a leg to stand on
tell him to shove it he's taking the pi** after all this time

you never answered my questions still - are you a trader and was it sold as new.
if it was clearly sold as 2nd hand - then it's tough. if however it was a new item and you're a trader then it should have some sort of 12 month warrenty.Leave a comment:

Hi i have replied to his email i will see what his response is money is not a issue here it,s matter of principle i think asking for refund after two and a half month is wrong i would have understood if he had contacted me within a week i would have refunded himLeave a comment:

dont be silly, all items are sold as seen if second hand but paypal/ebay have a policy of 30 days(dont quote me on the amount of days)

It makes a huge difference if it was a buy it now as well. As a buy it now item it is covered under normal distance selling laws, you are probably liable for a full 12 months and also the seller is liable for picking the faulty one up and replacing or refunding, the buyer doesn't have to send it back.Leave a comment:

if you sold it used as a private seller i would tell them politely to ~~~~ off its not your fault that it doesnt work it was working when sold
if your a business/power seller as kv said i think they use different rules and im not quite sure if you are liable although if its used im pretty sure you dont need to provide a guaranteeLeave a comment:

just check with paypal, cus i was forced to refund someone that decided they didnt want what they bought, check what the latest someone can claim(i think its 30 days)
if its past that, tell him to do one
