    Pub landlady wins in european court to show 3pm kick off

    A pub landlady has won the latest stage of her fight to air Premier League games using a foreign TV decoder.

    Karen Murphy had to pay nearly ?8,000 in fines and costs for using a cheaper Greek decoder in her Portsmouth pub to bypass controls over match screening.

    But she took her case to the European Court of Justice.
    The ECJ now says national laws which prohibit the import, sale or use of foreign decoder cards are contrary to the freedom to provide services.

    The decision could trigger a major shake-up for the Premier League and its current exclusive agreements with Sky Sports and ESPN.

        It?s not a bad idea as pubs are struggling to survive any way.

        Will they be breaking the law is a different matter!!!!!!!!!!!!!!!!!!!!!!

                It's my understanding that the advocate general has advised that murphy did nothing illegal. It has yet to go to court, which will by later this year.

                And whats the bet that Sky ,aka news international, will not buy up all the european rights (already have Germany and Italy). Then we will be back where we started.

                  what worries me is the part that if the forigen provider allows it to be used outside their country.

                  So really sky will still control it.

                  So if the premiership sell off to other countries, sky will be weighing down on top of them telling them to offer certain rights in conjunction with the broadcasting of the games.

                  Ie if you want to buy this you must not allow your cards to be used outisde your country.

                  Thus not allowing pubs not buy cards and view them.

                  So really nothing has changed.

                      They can't impose those rules, it's pretty much the same argument as the ECJ has just ruled on.

                        Not convinced this is as good as you all think. A country broadcaster will not own intelectual rights to the football match image, but the prem league will own the rights to it's own graphics. They supply the upload with prem league graphics all over it (just like now), and you would need permision to show the graphics.

                          well i think its great news!! and if you read all the reports its only the prem anthem and the prem logo I beleave it will make a massive difference for pubs now and since this case started pubs have been getting brave and more pubs showing 3pm kick offs, ~~~~ s*y

                              The point I was referring to is

                              The ruling will allow pubs to show football matches via foreign television decoders but only if rights holders allow
                              Now that would mean if skyuk tell you that their card must be solely for purpose in the UK but is used outside the uk, then you would break their T&Cs thus cancelling the card but you would possibly be exempt from prosecution unlike before.

                              Just like card sharing is not an illegal act but using a sky card in a 3rd party receiver is not illegal but it breaks skys t&cs.

                              So if any provider wants the rights at a cost then they can or could be instructed to amend their t&cs
