If I'm not mistaken, the possession of child ~~~~ is not a 'strict liability' offence, meaning there has to be knowledge or intent. This provision exists to protect those who innocently come to possess the offending material, and in most cases it does. The guy who bought the laptop with the ~~~~ on it is either guilty, or very unlucky. If the ~~~~ was already on the laptop when he bought it, then he must have left it as he found it and NOT deleted it. In that case, then he came to possess it himself with knowledge of what it was.

If you had read properly it says when he got home the laptop stopped working, had he knew there was offending material he would not have taken the laptop for repair in the shop.

The question remains unanswered at what stage would you charge some one for the offence when the crime is not 100% proven legally?????..

The courts don't just slap custodial sentences on people on a whim. There's a criminal justice process. Evidence is gathered. Testimonies are heard. The court obviously didn't believe his story. Link the case so we can read the finer details.

You need to actually read a court judgement to understand the kind of reasoning employed in these cases. Simply stating sensationalist headlines without providing any detail is typical of your ignorant, tabloid-reader mentality.
