A homeowner who made a website showing CCTV of thieves in his house has been threatened with jail unless he takes it down - because he didn?t have the burglars' consent.

The dad-of-three had captured masked thieves climbing over the wall of his house before breaking in through a kitchen window and stealing jewellery and his children?s piggy banks.

But since creating the site, Mr Waters has been threatened with a 100,000 Euro fine or a jail term - because of 'data protection'.

Cameras which he installed in his home in Killiney, south Dublin, showed them going from room to room in 'military precision' as they searched the house looking for valuables before fleeing within three or four minutes.

But within a couple of hours of ringing Joe Duffy on RTE Radio One's 'Liveline' show to publicise his website, Mr Waters got an email from the Data Protection Commissioner warning him that he is breaking the law by posting the images unless he has the prior consent of the criminals.

Mr Waters said: ?I've had more sleepless nights over the Data Protection Commissioner than I have had over the burglary.?

He should write back to them and say he has and ask them to prove otherwise. That would be interesting. Surely this would take a formal complaint from the burglars themselves before the information commissioner could then act. So they would then be grassing themselves in by attempting to get their images removed from the website. I think the IC has been heavy handed here and should have kept out of it UNTIL they recieved a complaint from one of the people on film...then the police would have had the right to obtain a court order to demand the details of the complainant as he/she are basically admitting to theft and burglary ....that's how I see it anyway.

We need to change the law, remember few years back you could not hit back intruder in your own property, we need similar change and what about the footage we get on BBC crime scene do they get permeation from thieves??

1) Put a sign up, entering these premisis you automattically agree to consent to putting unlawfull images up on www......

2) Was the camera in every room to stop his kids looking at INFERIOR websites.

3) Take them down off the website, but put still photos up

4) Take a drive to another town use free wifi to upload them to youtuba then somehow 'accidently' leave a youtuba link on his website
so it looks like somebody has leeched the video and uploead on youtuba

Technically he is stealing from the BBC. They own all copyright to all cctv footage. The footage will be shown in 12 months time when all the police have spent theyre allocated budget ont this case buying coffee and doughnuts and decide that the only option then is to get the public to grass on the people who done it.

I guess video is different from photos then ? as if you can be seen from a public place then you should expect your photo to be taken and used and after all I guess they could be seen entering the house by public so therefore legal therefore no breech.
