    But what he didn't do is list the car as off the road, spares or repair, unroadworthy or in any other way 'in need of repair before it can be driven on the road'.
    Neither did he have it checked to ensure it was roadworthy.

    Then there's the timing tensioner giving up on the second day of ownership. The Trade descriptions act means he has to either repair, replace or refund for the engine. Two days is not a reasonable amount of time.

    We'll see what happens. I'm picking up the report from the garage either today or tomorrow, the video & picks will be done by tonight. It's been reported to Consumer Services in Norfolk & details will be passed to trading standards. Once trading standards are involved they pick up all the expenses in talking this to court.

    I have nothing to lose, but a lot to gain from not letting him get away with this.

      did you drive the car home,was it taxed and had a valid mot.
      from what i read up until your last post i assumed it was the guys runabout and was in daily use

        Correct. Taxed till end of july, not aug as on listing, MOT till aug.

        Yes I did drive it home. After seeing the state of the trackrod end I'll consider myself very luck to make it home in one piece.

        Running at 60mph the only giveaway was the slight pull to the right & the klunk when I hit uneven road. At 30-40 mph on the roads I know very well the front of the car was shaking. Luckily that was on the way to get it looked at.

        Just to give you an idea as to how bad the trackrod end is, the klunking sound was the trackrod end... not the anti roll bar link.


        Update

        I now have the report from the garage confirming the car was unroadworthy.

          But who said the car was off the road? The guy is not a car trader as can seen frim his ebay feedback -first car he has sold in 5/6 years on ebay. He has said he has owned it couple of years so obviously HIS car . As you said in the other post the track rod was only noticable when doing sixty by the car pulling slightly and only felt clunk when on uneven road so if you werent doing sixty or on uneven road then you would have noticed anything and thats probably why the seller never noticed. Trading standards wont do anything as its private sale so I think all you are doing is winding yourself up.

            Not once has he said this was a private sale. Quite the opposite, he keeps insisting that this was a trade sale with no warranty. Ebay also confirmed that the listings were from a trade seller & they would not get involved because of this.
            Even if I had to take him to small claims I've got more than enough evidence to prove he committed a criminal offense.

            The ball is rolling & only time will show what happens. He will be sent the report from the MOT centre that looked at the car the day after I purchased it, the video & photo's showing the same faults & others found by another MOT tester/mechanic. Trading standards will be given the same information shortly after if he fails to come to an agreement.

            Other than the postage costs & a bit of petrol this is costing me nothing to put together. If you haven't worked it out yet, I don't back down or give in when I know I'm right.

            If you don't stand up for your rights, what's the point in having them in the first place.

                  Mate your'll just have to be a bit more careful, next time you get one of your mate's to list and shift one of yours on Ebay make sure they dont sell it to a DK member

                            I'd love to hear how you came up with this heavy weight answer. Before you answer read all my posts in this thread & then read section 75 of the road traffic act 1988, the trade descriptions act & sale of goods act. Don't forget to read trading standards stance on this kind of behaviour.

                            Gave him 7 days to reply.
                            I'll be keeping comsumer advice & trading standards informed.

                              i once had a dispute with a car trader and sent him a recorded delivery it never got signed for as far as i know its still at the mail office
