      trading standards will just tell u to get a solicitor , there useless m8


      take him to small claims its only 25 notes for them to send a letter and see how far he wants to go

        Bit of an update....

        After some more emails to trading standards we have some movement..... Sadly not the car moving under it's own steam.

        It's going to be picked up & taken to an engineer for the all important report.

        Will be starting repairs to it within a week of it's return. Got so much to do & not much time to do it.

        I had already decided to knock TS on the head & start up repairing the car. Keep tracks on the cost of the repairs. Then hitting him with a small claims order.
        Lucky timing with TS, now I can do both

            Bit of an update with the on-going saga.

            Got a letter from TS, tosspot has accepted a caution for selling a car in an un-roadworthy condition....




            He has admitted faults with 2 parts of the car, so a trip to court can only result in a judgement against him. It's just a case of getting the other faults added to the list.

            Gonna get some advice before I take my next step. Might look at settling out of court for a quick closure... But that depends on what advice I receive.

              but be aware the courts are a waste of space if it does come to anything he will probably say im not in work i can afford ?2 a week blah blah blah

              ~~~~ all you can do mate all he needs is an incomings and expenses form they cant take what he hasnt got


              unless you can prove otherwise they are toothless they dont send knife thugs to jail nowadays

              there is always a hope though that he isnt clued up and a court letter may frighten him but if he is like most people i know he will probably use it for loo roll

              small claims is about ?50 then about another ?100 for the hearing if memory serves me right you will get the money added if you win to your claim and he will have costs but be careful because like i said earlier you may get back not very much of it at all

                Had a quick look online. Court fees are ?70 for the amount I'm looking at.

                I can also add execution by bailiffs for a bit more money.

                Now he works from home, I've seen the house & the contents... including the huge polished mahogany desk he has in his office.


                I've waited this long & I have over 5 years to take this to court. Not that I'll be waiting that long before I send him a lovely letter.

                    The old adage "never buy a car without viewing first", rings true , time and again.
                    Similar experience i had on Ebay Mate, this time with a "classic" car.
                    I contacted the seller (a female), 4 or 5 times, in the week before the auction ended to ask many questions, she answered them all positively, the car was solid, dry, ran well, it had been her old dads for 20yrs, before he hung up his keys and gave it to her. But she had 3 kids and a VW golf and wasn't interested in it, hence it being stuck on her drive for 12months, since the MOT expired and she wanted shut!
                    When i asked could i view it, before the auction ended, she declined, saying the reason she put it on Ebay, was that she didn't want loads of people calling.
                    Like a fool and as we all like a bargain, i bid ?350 and won.....a rust bucket.
                    It took 2yrs, ?2500 and a lot of hard work: new floors, inner wings, front valance, inner and outer sills, new rear seat panels, inner boot panels, suspension rebuild, etc etc, you get the idea by now!
                    I was so sick of looking at it by the time i'd finished it, i sold it for ?1000 !

                      Guy I know just sold a tractor, happy buyer wanted to drive it home (quite rural round here).. got to the end of the drive (about 1km away - again, it's quite rural..) and *bang*... Gearbox assploded everywhere. Walked back down the drive and asked for his money back..

                      Unsurprisingly, he was successful in getting his refund. Not yet heard what caused the problem, but it's unlikely that the seller knew about it before the sale.

                      I think it's unlikely your seller would have known about a worn timing chain tensioner either. But, he probably did/should have known about the tyres, brakes and rod ends etc.

                      Hope it works out, sounds like you've taken the right approach so far

                        I currently have the engine stripped & trying to put it back together.

                        Bloody starter is causing more problems than it's worth. My plan is to crank it over with just the head & timing done. This should give me a good idea if I've fixed the problem.
                        Only the starter doesn't want to play ball. First the solenoid kicked in but no spinning cog. Fixed that but left it a week before having another go at it. Now it spins but the solenoid won't kick the cog out... I blame my brother-in-law. Don't know if he has actually touched it, but he usually breaks everything he touches.

                        I think he did know, he just didn't want to pay for all the repairs. It's either that or the mechanic he uses doesn't know the first thing about cars.
                        This is a crash course in diesel engines for me, I has scared the hell out of me. But even I knew something was wrong with the tensioners when I took them out. You don't need to strip the engine to remove them either. A 19mm socket is all that's needed.
                        If he said "the timing tensioner may need replacing" it would of cost me ?100 for both tensioners. Saving me from totally stripping down the engine & having to pay for more parts & tools.

                        Enough of the bitching. His time will come.

                            You shouldnt have handed any money over for the car without giving it a good inspection. Shouldve not bought and then reported him on ebay. Giving as reason why you never went though with purchase.

                            Bit like going out getting drunk pulling a fatty and waking up in the morning expecting to see a size 6 bird.

                            You have to inspect and expect things.

                              Using the term 'sold as seen' is illegal as it is trying to remove the buyers statutory rights.

                              You can sell a car as off the road, spares or repair, or even as needs trailering away. Which would mean work needs to be done/repairs needed, you would be safe from returns or faults. But if it's sold as on the road, it has to comply with all legal requirements & consumer laws. Which include what was the sales description act, distance selling act & road traffic act.

                              The fact that trading standards investigated & got an admission out of him proves my case. You can't hide behind dodgy words anymore.

                                a desk does not equate income

                                an incomings and outgoings form and a canny use of bank accounts and money earnt may see him in the red

                                which may mean you may get ?1 a week

                                courts are toothless m8 i cant stress to you enough you may win the case in court but doesnt mean you will get jack

                                no court in the land can take what you havent got he also has to be given the court order to attend court which means if his wife says he has left me you have to track him down to issue an order
