1st I didn't pay with a credit card so big mistake. Money came out of current account.
Paid ?770 for a mountain bike from individual. Poorly packed so got damaged in transit. Got Paypal involved and supplied 2 reports to saying bike damaged and beyond repair etc.
Asked to send it back for a refund.
Here's where it all goes wrong.
Rather than send it back via Parcelforce City Link or DHL I use a man with a van who collects the bike and takes it to the town the seller lives and tries 3 times to make delivery. Eventually he makes delivery and I send Proof of delivery to Paypal.
They reject my claim as I did not use company with online tracking as asked to do (they did ask me to do that).
However when I spoke to Paypal during the 4 day period that the transport company were unable to get the seller of the bike to accept delivery of it they did not say to me 'hang on mate, don't complete that delivery because we won't pay you out - they knew at that stage that it was not an online trackable company I was using).
So I have no money or bike.
I spoke to Financial ombudsmen who state Paypal are answerable to them, but I don't hold out much hope.
Paypal have a proof of delivery, this doesn't seem right.
Any suggestions?
